HON'BLE MR. JUSTICE SANJEEV PRAKASH SHARMA Order 11/02/2021 Learned counsel for the petitioner submits that had the offices been opened, the petitioner would have acquired qualification before the cut off date, however, as the offices were not opened the petitioner acquired the qualification only later on i.e. the cut off date. The qualifications is required for appointment, are to be seen as on the cut off date.
Since the petitioner admittedly did not possess requisite qualification under the advertisement upto the cut off date, subsequently acquiring of qualification which may have occasioned (Downloaded on 12/02/2021 at 10:57:11 PM) (2 of 2) [CW-907/2021] on any circumstances, cannot make him eligible under advertisement.
A sympathetic approach would cause discrimination vis-a-vis other who may not be applied as they did not possess qualification and may have acquired it subsequently.
The writ petition is found to be devoid of merit and it is accordingly dismissed.
All pending applications shall stand disposed of.
