This application is at the instance of a student of the respondent/University to re-examine the answer script Audit Paper-VIII, 3A of 3 year Degree Honours (under the new Regulation 1+1+1) Examination held in 2011 i.e., B.Com Part-III Examination.
Upon hearing the learned advocates of both the sides and on perusal of the materials on record, I find that previously the grievance of the petitioner was in respect of the result of Paper-V and Paper-VII of the said examination and for that reason he filed an application for review. The result of the review was nil i.e., the marks obtained by him were not changed at all. Thereafter she filed a writ petition being WP No. 19501 (W) of 2011 praying, inter alia, for production of answer script of the Audit Paper-VII of B.Com 3 year Degree Course Examination held in 2007. That application was disposed of, but by the present application after getting the answer script the petitioner has filed this present writ petition praying for re-examination of the answer script of Audit Paper-VIII, 3A of 3 year Degree Honours Examination held earlier in 2007.
So, I find that the present application is contrary to the prayer made in the earlier examination. Any way, the petitioner 2 got a chance of review in the earlier point of time and the result was nil. This being the position, I am of the view that there is no scope of entertaining the present application as per Rules of law of the respondent/University.
Accordingly, the application stands dismissed. There will be no order as to costs.
Urgent photostat certified copy of this order, if applied for, be given to the learned Advocate for the parties upon compliance of all requisite formalities.
