Heard Sri P.N. Saxena, learned counsel for the applicant-petitioner. Sri Gopal Ji Verma, learned counsel appears on behalf of respondents.

The contention of the petitioner is that in fact no enquiry was held as observed by the Enquiry Officer in its report and therefore the observation in the order that a departmental enquiry was conducted is not correct.

We do not find any substance in the submission of the learned counsel for the petitioner.

The enquiry report reveals that when a departmental enquiry was initiated and a charge sheet was given to the applicant he has admitted his guilt in respect of the charges. Therefore, the enquiry officer closed the enquiry proceedings and recorded his conclusion that in view of admission all the charges stand proved.

In view of the above, the review petition is misconceived and stands dismissed.
