1. Counsel for petitioners states that petitioners, belonging to OBC and General EWS category respectively, participated in the process of direct recruitment for the post of Basic Computer Instructor pursuant to advertisement dated 01.02.2022 and wrote examination on 18.06.2022, wherein they secured higher aggregate marks than the last cut off marks of selected candidate, but as minimum 40% marks in each paper were not secured, therefore, appointment to petitioners has been declined.

It has been submitted that according to Rule 28 of the Rajasthan Education (State and Sub-ordinate) Service Rule-2021, requirement of minimum 40% marks in each paper of the competitive examination has been added to the advertisement dated 01.02.2022 vide corrigendum notice dated 30.06.2022, it means after conducting the written examination on 18.06.2022, which is impermissible.

3. It has also been informed that other writ petitions involving identical and other points related to the present recruitment are pending before this Court, wherein notices have been issued and interim relief for allowing document verification of respective candidates has been permitted.

5. Issue notice to respondents.

6. In the meanwhile, petitioners are permitted to appear before the Rajasthan Staff Selection Board for document verification and the same would be done by respondents provisionally subject to outcome of the writ petition.

7. List on 31.01.2023 along with SBCWP No.13994/2022.
