                                 JUDGMENT

1. The above case has been Suo Motu registered by this Tribunal on the basis of the newspaper report published in Dinamalar Newspaper, Chennai Supplementary dated 18.02.2020 under the caption "fhy;thapy; fopT fyg;G jLg;G eltbf;if mtrpak;" (Mixing of sewage in rainwater drain canal - action requested).

2. It is seen from the newspaper report that large scale dumping of waste is being done in the storm water drain. There was no proper maintenance of the public drain at Nallappa Srinivasa Street, Chrompet leading to chocking of drain and resulting in large scale stagnation of drain water. It was also alleged in the newspaper report that untreated sewage is also mixed with the public drain, thereby affecting the health of the people. These places have become mosquito breeding areas and also produce foul smell and causing air pollution, which in turn leads to health hazards in the locality. Though complaints have been made to the authorities, no action has been taken so far. It is also mentioned in the newspaper report that a canal is leading to Chrompet Lake.

3. On the basis of the allegation, this Tribunal was satisfied that there arose a substantial question of environment and as per order dated 27.02.2020, this Tribunal had admitted the matter and appointed a Joint Committee comprising of Commissioner, Pallavaram Municipality and Tamil Nadu Pollution Control Board to look into the matter and submit a factual as well as action taken report, including remedial measures (if any) to be taken by suggesting short term and long term action plan with shorter time line so as to avoid such issues in future.

4. The case was originally posted to 05.05.2020 for that purpose. Thereafter, the matter has been adjourned from time to time by successive notifications and it was taken up on 10.06.2020 and on that day, this Tribunal had considered the report submitted by the Joint Committee signed on 05.06.2020 extracted in Para 3 of the order which reads as follows:-

"Inspection report of the joint committee constituted by the Hon'ble National Green Tribunal (Southern Zone) in respect of O.A.No.46 of 2020 in connection with the subject matter of mixing of sewage in rain water drain canal at Nallappa Street, Chrompet, Pallavaram Taluk, Chengalpattu District.
A case has been taken up suo motu by the Hon'ble National Green Tribunal l(SZ) on the basis of news item found in Tamil daily by name "Dinamalar" Chennai City supplement dated 18.2.2020 under the caption fhy;thapy; fopT fyg;G jLg;G eltbf;if mtrpak;. (Mixing of sewage in rain water drain canal - action requested).
It is submitted that Hon'ble National Green Tribunal (SZ) in its order in Original Application No.46 of 2020 dated 27.2.2020 has constituted a joint committee consisting of Commissioner, Pallavaram Municipality and Tamilnadu Pollution Control Boar to look into the matter and submit a factual and action taken plan to this Tribunal. If there are any remedial measures to be provided they are directed to suggest a short term and long term action plan report with shorter time lines so as to avoid such things in future.
The Committee is directed to submit the report to this Tribunal within a period of one month through email at [email protected]. Tamil Nadu Pollution Control Board will act as nodal agency for this purpose.

To comply with the Hon'be National Green Tribunal (SZ) order, the Joint Committee constituted carried out inspection of the said area on 17.3.2020 & 5.6.2020.
Observations During the inspection on 17.3.2020 & 5.6.2020 it was noticed that a rain water drain canal is in existence at the end of the Nallppa Street located at Ward Number 36, Pallavaram Municipality so as to have accessibility of rain water into Sembakkam Eri.
The said rain water canal is bounded by Pallavaram Municipal area in the Northern side and Citlapakkam Town Panchayat area in the southern side. The said rain water canal originate from Veeraraghavan Eri leading to Sembakkam Eri via Nallappa street, Pallavaram Municipality area were provided with underground sewerage system whereas there is no such sewerage system in the Citlapakkam Town Panchayat area but provided with septic tank arrangement.
As sullage water was being discharged into rain water drain canal from the following four houses located within the jurisdiction of Pallavaram Municipality were identified and the same pipe line connections were disconnected by Pallavaram Municipality immediately (Photographs enclosed)
1. Ramachandran, No.36, Nallappa Street, Chrompet, 600044.
2. Lenin, No.35, Nallappa Street, Chrompet, Chrompet, 600044.
3. Jaganathan, No.49, Srinivasan Nagar cross street, Chrompet, 600044.
4. Rajkumar, No.51, Srinivasan nagar cross street, Chrompet, 600044.
Also sullage water was being discharge into rain water drain canal from Thiruvalluvar Street and Govindasamy street coming under jurisdiction of 4 Citlapakkam Town Panchayat area were stopped by the Executive Officer, Citlapakkam."

5. This Tribunal had directed the committee to submit a further report regarding the allegations against the violators, including imposition of environmental compensation and also comprehensive steps taken for remedying the situation permanently and how the sullage water collected from the houses mentioned in the report are being diverted and ultimately Page 4 of 15 discharged and posted the case to 27.08.2020 for that purpose and thereafter, the matter has been adjourned from time to time.

6. Again, it was taken up on 13.10.2020 and at the request of the committee as well as local bodies, the case was adjourned to 18.11.2020 for submitting reports. Thereafter, it is being adjourned from time to time by successive notifications. Again, the matter was taken up on 16.03.2021 and considered the status report submitted by the Chitlakpakkam Town Panchayat dated 16.02.2021 e-filed and received on 19.02.2021 extracted in Para 3 of the order which reads as follows:-

"STATUS REPORT FILED BY THE 4TH RESPONDENT I, Tmt. N. Latha, presently discharging my duties as Executive officer of the Chitlapakkam Town Panchayat, Chitlapakkam, Chengalpet District, submit this status report as follows:
1. It is humbly submitted that the Chitlapakkam Town Panchayat was impleaded as 4th respondent by order of this Hon'ble Tribunal dated 13.10.2020, with direction to file status report and further action taken to avoid mixing of sewage in rain water canal.
2. It is submitted that the News item on Dinamalar, dated 18.02.2020, reported that the sewage is let into the rain water canal running through Govidnasamay Street, Kalaivanar street and Thiruvalluvar streets of Chitlapakkam.
3. In pursuance to the interim order of this Hon'ble Tribunal, the above site was inspected on 20.10.2020, and found that the following owners of the premises had discharged the sewage water into rain water canal. 1) Mr. Prabakar, No. 8, Govindasamy Street, Chitlapakkam 2) Mr. Rajendran, No. 3, Govindasamy Street, Chitlapakkam 3) Mrs. Parameswari, 2/9, Govindasamy Street, Chitlapakkam 4) Mrs. Anandhi, No. 5/6, Kalaivanar Street, Chitlapakkam 5) Mrs. Sesu Mariyal, No. 18, Thiruvalluvar St. (18C, 5th Street, Jiothi Nagar), Chitlapakkam
4. It is submitted that all of them were issued with show cause notice, to stop the sewage water from their premises mixing into rain water canal, within 3 days from the receipt of this notice failing which appropriate action would be imitated under relevant rules.

5. Further, all the six owners were imposed with fine amount Rs. 200/- for letting their sewage into rain water canal, causing hazardous to public health and vulnerable to communicable deceases. They all paid the fine amount, complied with directions and blocked their pipelines that drained sewage in water canal.
6. It is submitted that the above site was re-inspected on 16.11.2020 along with the District Environmental Engineer, Tamil Nadu Pollution Control Board and found that the sewage draining points on the rain water canal side were cut off, closed and ensured that no sewage water is entered into the rainwater canal from the above streets. Further, the Sanitary Inspector and sanitation team of Town Panchayat was instructed to watch those points and report immediately, if any recurrence of illegal draining of sewer into rain water canals.
7. It is submitted that the Sanitary Inspector has inspected those points on 20.01.2021, as directed by the Executive Officer, collected water samples to ensure that the sewage is not mixed with waste water from houses and reported the same with photographs.

This Hon'ble Tribunal may be pleased peruse the Photographs annexed for better appreciation of facts.

8. It is submitted that the Sanitary Inspector and the sanitation staff have been instructed to report any illegal draining of sewage waters into rain water canal without fail, for appropriate and timely intervention of Town Panchayat.

It is therefore prayed that this Hon'ble Tribunal may be pleased to record the this status and pass such further other orders deem so fit the case and thus render justice.

7. It was seen from the report that six persons were found discharging the sewage into the storm water drain and they had been identified and fine imposed. The connection to the sewage draining points on the rain water canal side were cut off, closed and ensured that no sewage water enters into the rain water canal from the streets. At the request of the 3 rd respondent, the matter has been adjourned to 13.04.2021 for consideration of further report.

8. On 13.04.2021, this Tribunal had considered the status report submitted by the 3rd respondent dated 07.04.2021, e-filed on 09.04.2021 and received on 12.04.2021 extracted in Para 2 of the order which reads as follows:-

"Report filed by the 3rd Respondent I, Mathivanan, Son of Chelliah, Hindu aged about 57 years, working as Commissioner, Pallavaram Municipality, Chennai - 44 do hereby solemnly affirm and sincerely state as follows:-
1. I am the Commissioner of the Pallavaram Municipality, the 3rd respondent herein and well conversant with the facts of the case from the connected files.
2. It is submitted that the news item on Dinamalar, dated 18.02.202, reported that the sewage is let into the rain water canal running through Nallappa Srinivasa Street in Pallavapuram Area and Govindasamy Street, Kalaivanar Street and Thiruvallur Streets of Chitlapakkam.
3. Subsequent to the orders passed by this Hon'ble Tribunal the Joint Committee comprising of Commissioner, Pallavapuram Municipality and District Environmental Engineer, Chengalpet District on 17.03.2020 and 05.06.2020. During the inspection on 17.03.2020 & 05.06.2020 it was noticed that a rain water drain canal is in existence at the end of the Nallappa Street located at Ward No.36, Pallavaram Municipality so as to have accessibility of rain water into Sembakkam Eri. The said rain water canal is bounded by Pallavaram Municipality area in the Northern side and Chitlapakkam Town Panchayat in the southern side.
4. The said rain water canal originate from Veeraraghavan Eri leading to Sembakkam Eri via Nallappa Street, Pallavaram Municipality area were provided with underground sewerage system whereas there is no such sewerage system in the Chitlapakkam Town Panchayat area but provided with septic tank arraignment. As sullage water was being discharged into rain water drain canal from the few houses located within the jurisdiction of Pallavaram Municipality were identified and the same pipe line connections were disconnected by Pallavaram Municipality immediately.
5. The following four persons were identified during the inspection and the connections to the rain water drain was disconnected immediately and a fine of Rs.500/- was imposed to the violators.
(i) Ramachandran, No.36, Nallappa Street, Chrompet.
(ii) Lenin, No.35, Nallappa Street, Chrompet.
(iii) Jaganathan, No.49, Srinivasan Nagar Cross Street, Chrompet.

(iv) Rajkumar, No.51, Srinivasan Nagar Cross Street, Chrompet.

6. It is submitted that the Sanitary Inspectors has inspected the concerned area to ensure that the sullage water is not mixed with the Rain Water Drain.

7. It is submitted that the Sanitary Inspector and the sanitation staff have been instructed to keep constant vigil and report any illegal draining of sullage waters into rain water canal without fail, for appropriate and timely intervention of Municipality. Further, action for stopping any flows into the rain channels is being taken up on a regular basis. Therefore, it is submitted that the respondent herein has taken all steps to stop the flow of any kind of waste water to the water body. It is therefore prayed that this Hon'ble Tribunal may be pleased to record the status and pass such further other orders deem so fit the case and thus render justice.

In the foregoing circumstances, it is prayed that this Hon'ble Tribunal may be pleased to accept the above and pass suitable orders and thus render justice."

9. After considering the above report, this Tribunal had noted that though the committee was directed to inspect and submit a further inspection report, but the committee had not submitted the report to this Tribunal. So, this Tribunal had directed the committee to submit further report and posted the case to 21.05.2021 for that purpose. Thereafter, the matter has been adjourned either by notification or at the request of the parties for submission of report and lastly, it was taken up on 23.06.2021 and at the request of the parties, the case has been adjourned to today for submitting further reports.

10.When the matter came up for hearing today through Video Conference, Dr. D. Shanmuganathan through Mr. Arun represented respondents 1 & 4, Mr. C. Kasirajan through Ms. D. Ashwini represented 2nd respondent and Mr. Purushothaman represented Mr. P. Srinivas for 3rd respondent. Page 8 of 15

11.We have received further report submitted by the Joint Committee dated 22.06.2021, e-filed on the same day and received on 25.06.2021 which reads as follows:-

"ACTION TAKEN REPORT OF THE JOINT COMMITTEE CONSTITUTED BY THE HON'BLE NATIONAL GREEN TRIBUNAL (SOUTHERN ZONE) IN RESPECT OF O.A No.46 of 2020 ON THE BASIS OF THE PAPER REPORT PUBLISHED IN THE DINAMALAR NEWSPAPER - CHENNAI SUPPLEMENTARY DATED 18.02.2020 UNDER THE CAPTION "MIXING OF SEWAGE IN RAIN WATER DRAIN CANAL - ACTION REQUESTED" AT NALLAPPA STREET.CHROMPET, PALLAVARAM TALUK, CHENGALPATTU DISTRICT ORDERS OF THE HON'BLE TRIBUNAL It is respectfully submitted that a case has been taken up Suo Moto by the Hon'ble National Green Tribunal (SZ) on the basis of the paper report published in the Dinamalar Newspaper - Chennai Supplementary dated 18.02.2020 under the caption "Mixing of Sewage in Rain Water Drain Canal - Action Requested"

It is respectfully submitted that Hon'ble National Green Tribunal (SZ) in its order in Original Application No. 46 of 2020 dated 27.02.2020 has constituted a joint committee consisting of Commissioner, Pallavaram Municipality and Tamilnadu Pollution Control Board.

It is respectfully submitted that the joint committee as constituted, submitted the report before the Hon'ble Tribunal. The Hon'ble National Green Tribunal in its order dated: 13.10.2020 directed the committee and the local bodies M/s. Pallavaram Municipality and M/s. Chitlapakkam Town Panchayat to furnish the further report.

It is respectfully submitted that the said rain water drain canal in the area in question is leading to Sembakkam eri. The said canal is bounded one side by the local body area of Pallavaram Municipality and other side by Chitlapakkam Town Panchayat. Pallavaram Municipality has identified and disconnected the pipe line discharging sewage/sullage in the said rain water drain canal and a fine of Rs.500/- each was imposed to the following Violators at Nallappa street, Chrompet.

(i) Mr. Ramachandran, No.36, Nallapa Street, Chrompet.
(ii) Mr. Lenin, No. 35, Nallappa Street, Chromepet
(iii) Mr. Jaganathan, No. 49, Srinivasan Nagar Cross Street, Chrompet.

(iv) Mr. Rajkumar, No. 51, Srinivasan Nagar Cross Street, Chrompet.

It is respectfully submitted that M/s. Chitlapakkam Town Panchayat has identified and disconnected the pipe line discharging sewage/sullage in the said rain water drain canal and levied a fine of Rs.200/- each to the following violators in the area in question i. Mr. Prabakar, No. 8, Govindasamy Street, Chitlapakkam ii. Mr. Rajendran, No. 3, Govindasamy Street, Chitlapakkam iii. Mrs. Parameswari, 2/9, Govindasamy Street, Chitlapakkam iv. Mrs. Anandhi, No. 5/6, Kalaivanar Street, Chitlapakkam v. Mrs. Sesu Mariyal, No. 18, Thiruvalluvar St. (18C, 5th Street, Jiothi Nagar), Chitlapakkam.

It is respectfully submitted that the said area in question was again inspected by the joint committee on 14.06.2021 & 19.06.2021 and observed the following.

1. There is no discharge of sewage from the residences in the area in question in the storm water drain running near Nallappa Street, as the erring houses in Nallappa Street situated on the banks of the Canal were imposed with fine and the discharge outlet were closed, now there are no such issues of letting sewage into the canal from the area in question.

2. Whereas in the downstream of the storm water drain canal i.e from Srinivasa nagar, Haridosspuram, Raman street, Vivekananda street upto the confluence point of Sembakkam eri. It was noticed number of residences are letting out the sullage water into the said rain water drain canal leading to Sembakkam lake.

3. Photographs taken during the inspection, i.e rain water drain canal near Nallappa street and downstream of Nallappa street.

RECOMMENDATIONS OF THE COMMITTEE Based on the above observation, the Joint Committee submits the following recommendation before the Hon'ble National Green Tribunal (Southern Zone)

1. Both the Pallavaram Municipality and the Chitlapakkam Town Panchayat shall take immediate action to disconnect the pipe line carrying the sullage water within a period of 20 days from the houses in their local body area into the storm water drain downstream to the area in question all along its course till the confluence point of Sembakkam lake.

2. Pallavaram Municipality and Chitlapakkam Town Panchayat shall remove all the solid waste dumped in the said storm water drain canal from Nallappa street upto confluence point of Sembakkam lake within a period of one week.

3. Pallavaram Municipality shall further constantly maintain the underground sewer line network for proper collection and transportation of the sewage water without chocking, leading to overflow into the said rain water canal at any point of time in their jurisdiction and shall impose fine on the violators.

4. Chitlapakkam Town Panchayat shall constantly monitor and ensure that no sewage/sullage water discharge into the said rain water rain canal at any point of time in their jurisdiction and shall impose fine on the violators.

5. The said local bodies shall periodically inspect the said rain water drain canal to prevent the discharge of sewage/sullage and dumping of solid waste."

12.We have also received further report submitted by the 3 rd respondent dated 03.07.2021, e-filed and received today which reads as follows:-

"REPORT FILED BY THE 3rd RESPONDENT I, Mathivanan, son of Selliah, Hindu aged about 58 years, working as Commissioner, Pallavapuram Municipality, Pallavapuram, do hereby solemnly affirm and sincerely state as follows;
1. I submit that I have perused the order of this Honourable Tribunal dated 31-05-2021. I submit that as per the initial orders of this Honourable Tribunal, the Joint Committee was already formed with this Respondent and the D.E.E. TNPCB.
2. The members of the Committee with the Officers of the Municipality and also the Officers of the Adjacent Chitlapakkam Town Panchayat had inspected the Rain water Drain that leads to the Sembakkam Eri. This Channel is between the limits of the Pallavapuram Municipality and the Chitlapakkam, Town Panchayat.
3. During the inspection it was found that some houses that are abutting the Rain Water Channel where discharging their sullage into the adjoining channels and this was in turn reaching the Sembakkam Eri.
4. It was directed to the individual Local bodies to carry out the work of disconnecting the Sullage outfalls that are reaching the Channel. Accordingly the Pallavapuram Municipal Workers have identified the outfalls and the same have been plugged. Further the residents of the said houses were also imposed fines of Rs.500/- under the Public Health Act for the illegal discharge of sewage.

5. The following are the houses on the Nallappa street with Door numbers that were found to the discharging their sullage into the channel.
1. Mr. Ramachandran, Door No.36
2. Mr. Lenin, Door No, 35, both in Nallappa Street, Chromepet
3. Mr. Jaganathan, Door No. 49, Srinivasan Nagar Cross Street and
4. Mr. Rajkumar, Door No. 51, Srinivasan Nagar Cross Street.
6. The Further inspections on 14-06-21 and 19-06-21 found that the discharges into the Channel in Nallappa Street were all plugged and there was not outfall into the Rainwater Channel.
7. Further the work of identifying any other areas where the discharge of drainage into the Rain Water Channels was undertaken on the direction of the Joint Committee and the downstream areas on the way to the Sembakkam Eri were also inspected and some outfalls of Sullage in Srinivasa Nagar, Haridosspuram, Raman Street, Vivekananda Street were noticed and notices have already been issued to the said houses to stop their discharge of drainage into the Channel.
8. The work of plugging of the outfalls into the Rain Water Channel was carried out and the same was completed on 30-06- 2021. For all the said residents in the above localities who were discharging their Sullage into the rain water channel, the fine of Rs.500/- is being imposed and also they have been directed to connect their Sewage pipelines to the UGSS of the Pallavapuram Municipality.
9. Further the Joint Committee has also found that Solid waste materials have been dumped by the residents into the Channel in some places. The Officers of the Municipal Health Section have been directed to immediately take steps to remove the said solid wastes from the Channel and this work was completed on 02-07- 2021.
It is therefore prayed that this Honourable Tribunal may be pleased to pass suitable orders in this regard in O.A. No 46 of 2020 and thus render justice."

13.It is seen from the Joint Committee report that when they inspected the area again on 14.06.2021 and 19.06.2021, there was no discharge of sewage from the residences in the area in question which was reflected in the newspaper report in the storm water drain running near Nallappa Street, as the erring houses in Nallapa Street situated on the banks of the Canal were imposed with fine and discharge outlet were closed and there was no such issues of Page 12 of 15 letting sewage into the canal from the area in question. But in the downstream of the storm water drain canal i.e., from Srinivasa Nagar, Haridosspuram, Raman Street, Vivekananda Street upto the confluence point of Sembakkam Eri, it was noticed that number of residences are letting out the sullage water into the said rain water drain canal leading to Sembakkam Lake.

14.It is seen from the latest report submitted by the 3 rd respondent which was extracted above that they have identified the persons in the areas mentioned in the further report namely, Srinivasa Nagar, Haridosspuram, Raman Street, Vivekananda Street and notices have been issued to the said houses to stop discharge into the canal and they have completed plugging of drain water in those areas which was completed on 30.06.2021 and fine was also imposed to the tune of Rs.500/- and they have been directed to connect their sewage pipelines to the Under Ground Sewage System (UGSS) of the Pallvapuram Municipality. Regarding the removal of dumping of waste is concerned, they have directed the Municipal Health Section to take immediate steps to remove the waste and garbage from the canal and the same was completed on 02.07.2021.

15.Since the grievance raised in the newspaper report has been redressed, we feel that the application can be disposed of with following directions:-

(i) The various reports submitted by the Pallavaram Municipality, Chitlapakkam Town Panchayat and also the Joint Committee report are recorded and accepted.
(ii) Since it is a continuing nuisance, the Pallavaram Municipality as well as Chitlapakkam Town Panchayat Page 13 of 15 are directed to make sure that no untreated sewage from the residences are discharged into the storm water drain which ultimately reaches the Sembakkam Eri.
(iii) The Pallavaram Municipality as well as the Chitlapakkam Town Panchayat are directed to take steps to connect the sewage line from the residences to the Under Ground Sewage System (UGSS) and take appropriate action against those residents who are not complying with the directions issued by them to connect the sewage line to the Under Ground Sewage System (UGSS) provided by them in accordance with law.
(iv) The Chitlapakkam Town Panchayat and the Pallavaram Municipality are directed to carry out the cleaning and desilting of the storm water drain periodically, so as to avoid chocking of water overflowing into the streets and stagnation there during monsoon to cause health hazards in future as complained of in the newspaper report.
(v) The District Collector, Chengalpattu District is directed to see that no such complaints are forthcoming in future from the public by directing the Pallavaram Municipality as well as Chitlapakkam Town Panchayat to carry out the maintenance work and also avoid chocking of storm water drain with garbage and other waste and also discharge of untreated sewage water into the storm water drain.

16.The Registry is directed to communicate this order to the Pallavaram Municipality as well as Chitlapakkam Town Panchayat and also to the District Collector, Chengalpattu District for information and compliance of the direction.

17.With the above observations and directions, this application is disposed of.
