Today when the present appeal is taken up for further hearing, Ms. Rekha Pandey, learned counsel appearing on behalf of the Union of India has stated at the Bar and as such, has placed on record the communication from the Superintendent, Central Jail, Ludhiana stating that the appellant-convict has been released on Premature Release as per Section 161 of the Indian Constitution on 10 July 2013 as per Order No. 50206/3/22P/A3 dated 18 June 2013 passed by Shri A.K. Sharma, Colonel Staff Officer (Discipline and Vigilance) for General Officer Commanding Shri Ashwani Kumar, Major General Officer Commanding.
In view of the fact that the appellant has already been prematurely released, we dispose of the present appeal.
