7. 19.8.2008Heard the appellant in person, who has submitted that in all notices against respondent no.1 have been sent thrice in the past but on all the occasions respondent no.1 has been managing to refuse to receive notice either on the ground that he is out of station or has gone outside or not available. This shows deliberate act of the respondent no.1.
Notice against him will be deemed to have been validly served.
