1. Exemption allowed subject to all just exceptions.

2. Application stands disposed of.

3. This is a case in which the Detailed Medical Examination 1 and the Review Medical Examination 2 both found the respondent suffering from hypertension.

4. We also note that there was a period of seven days between holding of the DME and the RME.

5. The RME also notes that the finding has been returned after a proper evaluation and examination of the candidate.

6. Despite this, the Central Administrative Tribunal 3 has directed a fresh medical examination.

7. The sustainability of this direction may be questionable by the law laid down by us in Staff Selection Commission v Aman Singh4.

8. Accordingly, issue notice to show cause as to why rule nisi be note issued.

9. Notice be served on the respondent by all modes as well as through Counsel who appeared on his behalf before the Tribunal.

10. Counter affidavit, if any, be filed within three weeks with advance copy to learned Counsel for the petitioners, who may file rejoinder thereto, if any, within one week thereof.

11. Re-notify on 19 March 2025.

12. In the meanwhile, there shall be a stay of operation of the judgment passed by the Tribunal.
