ORAL ORDER
2 18-09-2014Heard Mr. Radhey Shyam Agrawal, learned counsel for the petitioners.
The present application has been put up seeking quashing of the First Intimation Report of Sadar P.S. Case No.209 of 2012 instituted for investigating the offence under Sections 420, 468, 471 and 120(B) of the Indian Penal Code.
The counsel for the petitioners submits that the informant of the case is the mother of the petitioners and even accepting all the averments made in the First Information Report to be ex-facie true, no offence can at all be said to have been Patna High Court Cr.Misc. No.47089 of 2012 (2) dt.18-09-2014 2/2 made out.
Since the First Information Report has been registered in the year 2012 only, it can safely be presumed that the investigation has proceeded. In case the petitioners have any defence or grounds, to demonstrate their innocence, they may do so by pointing out the same grounds to the investigating agency.
This Court is not inclined to interfere with the process of investigation, which is plenary to the powers of the police.
In that view of the matter, the application is thoroughly misconceived. It is hereby dismissed.
