CM No. 4412/2022This is an application seeking restoration of the appeal that has been dismissed for non-prosecution on 5th August, 2022.
The instant application is well within time and it is pleaded in the said application that earlier counsel Mr. Abdul Rehman Bhat, had left the practice and this fact was not known to the applicants/appellants which resulted in the dismissal of the appeal for non-prosecution.
Having regard to the cause shown, the application deserves to be allowed and accordingly the instant application is allowed and the appeal after its restoration is re-admitted to hearing.
Let the main appeal be listed for Final Hearing on 16.02.2023.
