The application having been heard on 07.12.2021, the Tribunal on the
same day delivered the following:
ORDER
Per: Mr. P. Madhavan, Judicial Member Being identical the above O.As were heard together and are disposed of by this common order.
2. Almost identical reliefs are claimed in all the above O.As. For the sake of convenience the facts of O.A No. 180/00574/2018 is taken up for consideration.
15 O.A No. 180/00574/2018 & Connected Cases3. The applicants have filed OA No. 180/00574/2018 seeking the following reliefs:
"i) Issue an order quashing and setting aside Annexure A-4 regulation to the extent it provides for Sr. SSAs being the feeder category for promotion to the post of Section Supervisor.
ii) Holding that Annexure A-4 is bad in law in so far as it does not provide for retention of SSAs with the eligibility prescribed in Annexure A-3 in the feeder category.
iii) Issue an order directing the respondents to fill up the back log vacancies of Section Supervisors ought to be filled up as per Annexure A-6 on the basis of Annexure A-3 Rules.
iv) Hold that the applicants are eligible to participate in the selection notified as per Annexure A-6."
4. When the matter came up for consideration, learned counsel for the ESIC submitted that he has filed a statement on 02.11.2021. It reads as follows:-
"1. Vide letter dated 21.10.2021 the EPFO Head Office had informed that the Competent Authority has decided to accept and implement the direction of the Hon'ble CAT, Chandigarh Bench which in its order dated 28.11.2019 in the matter of O.A No. 60/784/2018 had directed to fill up the vacancies of SS existing as on 31.03.2017 according to the Old Rules of 1992 as amended in 2006, and to consider the applicants and others as per their eligibility as on 31.03.2017. In view of the above direction, this Hon'ble Tribunal may kindly close this O.A and connected cases which are O.A Nos. 577/18, 580/2018, 581/2018, 583/2018, 584/2018, 599/2018, 600/2018, 613/2018 and 618/2018."
5. Recording the above submission made by the counsel for the respondents quoted above, the O.As are disposed of. The applicants are also entitled to the same benefits as granted in O.A No. 782/2018 (Suresh Kumar Chauhan v. Central Board of Trustees through its Chairman, Sharam Shakti Bhawan, Rafi Marg, New Delhi & Others). No order as to costs.
