 1.       Shri Anil Khanna    filed an application dated 15.06.2009 under the Right to Information 

Act,  2005 (RTI Act) before the Central Public Information Officer (CPIO), Central Vigilance  Commission (CVC) seeking information on five points relating to his four complaints against Shri  P.K. Jain, In ­charge Engineer, Engineering Branch, JNU, New Delhi

2. Shri Anil Khanna filed a complaint dated 26.11.2010 before the Commission on the grounds  that the CPIO denied the information under Section 8(1)(h) of the RTI Act, 2005 and the First  Appellate Authority (FAA) too has upheld the decision of the CPIO. The appellant requested the  Commission to direct the CPIO to provide information to him.

Hearing:

3. The   appellant   Shri   Anil   Khanna   was   not   present   despite   notice.   The  respondent   Shri  Mukesh Kumar, Director, CVC was present in person.

4. The respondent submitted that a similar case has already been heard and disposed of by the  Commission vide Decision No. CIC/WB/A/2009/000933­SM dated 10.03.2011.

Decision:

5. The Commission observes that a similar case has already been decided by the Commission  vide Decision No. CIC/WB/A/2009/000933­SM dated 10.03.2011. The decision taken in the earlier  matter would also apply to present matter. Hence, no further action is required in the matter.

6.  With the above observation, the appeal is disposed of.
