ORDER
Facts:
1. The appellant filed an RTI application on 2792011 seeking information pertaining to two Dharamshalas and related issues.
2. The appellant filed an appeal with the first appellate authority (FAA) on 11112011.
The FAA responded on 19122011 and directed the CPIO to provide the information to the appellant. The CPIO responded on 20122011 after the directions of the FAA on 1912 2011 and informed the appellant that the matter had to be examined by the DDA and the appellant informed. A second appeal was filed by the appellant with the Commission on 2712012.
Hearing:
3. I heard both the parties in person. The appellant referred to his RTI application of 2792011 and stated that questions were asked which should have been responded to in full detail by the DDA taking into account that the RTI application was motivated solely by public purpose. The appellant stated that the respondent has simply stated that the matter was being examined and that the information would be sent in due course.
4. The respondent stated that they have no intention of withholding any information.
However, they could not locate the RTI application and this was the reason for the response not being sent on time. The respondent stated that once a copy of the RTI application is given to the DDA, the response will be send in the next week or 10 days.
5. The appellant stated that the respondent is needlessly avoiding giving information and this has been the cause of great harassment to the local residents. The appellant said that the DDA is deliberately ignoring the encroachments being caused by these dharamshalas which are situated on a very narrow road and which are functioning on a commercial basis contrary to the terms and conditions on which the land had been allotted to the concerned organization. The appellant stated that the activity taking place in the premises is a source of big nuisance to the residents on account of the unauthorized use of loudspeaker and loud music and the result is that the students are not able to study which has led to a serious situation.
6. The information should be provided in full.

7. The respondent is directed to provide to the appellant the information sought in the RTI application of 2792011. Compliance must be done within 30 days from the issuance of this order.
Appeal is disposed of. Copy of this order be given free of cost to the parties.
