                                    ORDER

1. The Complainant filed an RTI application dated 20.01.2023 seeking information on the following points:

(i) When was public advertisement/notice given for requirement for empanelment of jewel appraisal given, how many jewellers/candidates applied for jewel appraisal, what is the eligibility criteria for jewel appraisal during financial year 2022-23 & I need advertisement copy, the scrutinised documents of all the jewellers who were applied & documents of present jewel appraisal working of Murgod branch PIN-

2. The CPIO replied vide letter dated 20.02.2023 and the same is reproduced as under:-

     (i)        No such advertisement was given.
     (ii)       For Murgod Branch only one application was received.
     (iii)

• The Appraiser should be a skilled goldsmith having minimum 3 years of experience in the similar line of business • The Gold Jewel Appraiser should not be closely related to the staff of the branch for which he is empanelled.

• Minimum education stipulated is 10 class pass. qualification Minimum Age is restricted at 30 years • The maximum age is 60 years. Branches to obtain proof of date of birth/age for new appraisers at the time of empanelment.

• Practical experience of 5 years in appraising/ handling gold Jewellery is stipulated. Proof of such experience certificate from previous employer, Certificate from Jewel appraiser Association etc. need to be obtained. • The Appraiser should not be convicted of any criminal offence and sentenced to a term of imprisonment in the past.

(iv) As no advertisement was given, copy not available.

3. Dissatisfied with the response received from the CPIO, the Complainant filed a First Appeal dated 06.03.2023 alleging that the information provided was incomplete, false and misleading. The FAA vide order dated 17.03.2023 observed as under:

"The appellant is questioning the empanelment/appointment of jewel appraiser, Murgod branch and seeking inquiry into the matter, which cannot be dealt under the RTIA. The appellant has no case that the CPIO has denied or refused information. The appeal filed by the Applicant under RTI is in the nature of a dispute/grievance and this office is not the proper forum to look into the Appellant's grievances.

4. Aggrieved with the FAA's order, the Complainant approached the Commission with the instant Complaint dated 14.06.2023.

5. The Complainant and on behalf of the respondent Ms. Avarthi Royrniyar, Regional Head, attended the hearing through video conference.

6. The Complainant inter alia submitted that jewel empanelment was not done as per rules as no public advertisement/notice was issued by the respondent office. He further submitted that the reply furnished by the CPIO was not in accordance with the information sought in the RTI application. He requested the Commission to direct the respondent to provide the information, as sought.

7. The respondent while defending their case inter alia submitted that a point-wise response to the RTI application had been furnished to the complainant vide their letter dated 20.02.2023. Regarding jewel empanelment, she submitted that no advertisement was issued but a notice had been displayed on the notice board of the branch concerned.

The Commission after adverting to the facts and circumstances of the case, hearing both parties and perusal of records, observes that the respondent had provided point-wise information or reply to the complainant vide letter dated 20.02.2023. It was not the case that the respondent had not given any reply to the Complainant and no mala fide could be attributed to the decision taken by them. Perusal of the records further revealed that the Complainant had grievance with regard to empanelment of jewel appraiser by the respondent which could be raised before an appropriate forum. That being so and the reply having been given to the complainant, there appears to be no merit in the complaint. With this observation, the complaint is closed.

Copy of the decision be provided free of cost to the parties.
