We have heard learned counsel for the parties and find that the High Court has not dealt with the issue that has been raised.
In our opinion, the matter needs to be looked into by the High Court again.
Under the circumstances, we set aside the order passed by the High Court and remand the matter back to the High Court for consideration on merits. The appeal is accordingly disposed of.
