ORDER
Date : 10-09-2020 Heard Mr. K.N. Choudhury, learned senior counsel for the applicants in I.A. No. 1350/2020. Also heard Ms. D Borgohain learned counsel for the writ petitioner and Mr. D Saikia learned senior counsel for the state respondents.
2. The writ petition WP(C) No. 2625/2020 was instituted with the following prayers:
(i) set aside the impugned Speaking Order dated 18.05.2020 so far as it seeks to fill up the 83 posts under restructuring SCERT without restructuring the DIETs,
(ii) upgrade the DIETs in Assam with effect from the date of restructuring the SCERT,
(iii) constitute a common cadre of Teacher Educators in Page No.# 7/7 Assam,
(iv) confer the financial benefits on the members of the petitioner Association w.e.f. the date of restructuring of SCERT and and on cause/causes being shown, if any, and upon hearing the parties and on perusal of the records would be pleased to make the Rule absolute and/or pass such other order or orders as to Your Lordships may deem fit and proper in the facts and circumstances of the case And Pending disposal of the Rule direct the respondent No. 2, 3 and 4 not to give effect to the impugned Speaking Order dated 18.05.2020 and/or pass such other order or orders as to Your Lordships may deem fit and proper in the facts and circumstances of the case."
3. The applicants herein are the members of the service under SCERT whereas the writ petitioner is an association of the employees under the DIET and are seeking for a direction that the DIET be suitably upgraded with effect from the date of restructuring of the SCERT.
4. According to the applicants any such direction granted would affect their legal right and therefore, they are of the view that they are the necessary parties in this proceeding.
5. In any view of the matter, learned counsel for the writ petitioner as well as respondents do not object the prayer of the applicants being arrayed as respondents in WP(C) No. 2625/2020.
6. Accordingly, the applicants herein being 27 in numbers are impleaded as respondents no. 7 to 33 in WP(C) No. 2625/2020.
7. Office to make necessary corrections in the cause title of WP(C) No. 2625/2020.
I.A. stands allowed as indicated above.
