5 20-04-2018In compliance of order dated 06.10.2017, the petitioner has not filed affidavit in support of publication of general citations in 'Times of India and Dainik Jagran'.
Special citations were issued to 11 near relatives under both modes. The process server has reported that near relatives B, D, I, J received personally. Near relative D received special citation on behalf of near relatives A, C, E, F, G and H also as they are living on same address. Shashi Arora, the sister received special citations on behalf of near relative K. The postal peon has reported that near relatives C, E and J received personally. Archana Arora received special citations on behalf of near relatives F, G and H. Wives of near relatives A, D received special citations. Registered cover of near relatives B and K return without any mark. Near relative A as well as Patna High Court TEST CASE No.6 of 2016(5) dt.20-04-2018 2/2 Seema Kapoor, Sagar Kapoor, Shreshtha Chaudhary @ Shreshtha, Puja Kapoor and Megha Kapoor have filed their Vakalatnama, besides near relative A. Others are not mentioned as near relative in the petition.
Under the circumstances, service of special citation upon near relative A as he has already filed Vakalatnama. Near relatives B, C, D, E, I and J as they have received special citations personally are held validly served.
The petitioner is directed to file affidavit of jointness of Archana Arora with near relatives F, G and H and Shashi Arora with near relative K. The petitioner is also directed to file affidavit in support of publication of general citations in 'Times of India and Dainik Jagran' within four weeks. Put up on 18.05.18.
