                     Prayer :- Petition filed under Article 227 of the Constitution of India, to
                     withdraw DVC No.03 of 2021 pending before Judicial Magistrate No.I,
                     Mannargudi and transfer the same to Thanjavur Family Court and try
                     along with HMOP No.152 of 2020 (on the file of Family Court,
                     Mannargudi) and HMOP No.44 of 2020 (on the file of Principal Sub
                     Court, Trichy) both the cases were transferred by this Court order in
                     Tr.C.M.P(MD) No.166 of 2021 dated 27.09.2021.

                                                           ORDER

A joint memorandum of compromise has been filed by the parties, in which, Ramadhas, the husband, who is the petitioner and Jenny, the wife, who is the first respondent have agreed that both of them would file a petition for divorce by mutual consent. The husband has agreed to pay a sum of Rs.17 lakhs, of which, Rs.10 lakhs has already been given to the first respondent by way of Demand Draft. The balance Rs.7,00,000/- is payable, when the proceedings in DVC No.03 of 2021 on the file of the Judicial Magistrate No.I, Mannargudi, is quashed. The memorandum of Compromise is taken on file.

2.This Civil Revision Petition is disposed of in terms thereon. A direction is given to the Family Court, Thanjavur to take up the petition for mutual consent as and when it is filed and the time that has been taken for prosecuting HMOP No.44 of 2020 shall be taken note of _________ Page 2 of 5 https://www.mhc.tn.gov.in/judis C.R.P.(MD)No.1685 of 2021 and six months period shall be waived. The learned Judge shall proceed to pass orders granting divorce within a week from the date of the filing of the petition. No costs. Consequently, connected miscellaneous petition is closed.
