2. The State has been served but is not represented.
3. Learned counsel for the appellant and the complainant present before us agree that the sum of Rs.
3.75 lakhs which had been deposited by the appellant in this Court be paid to the complainant. It is further agreed that interest at the rate of six per cent per annum from the date of issuance of the cheque till the date of deposit in this Court shall also be paid to the petitioner-complainant within one month.

4. In this view of the matter, we, accordingly, quash FIR NO. 246 dated 11th August, 2009, DLF Police Station, Gurgaon.
5. Appeal stands disposed of in the aforesaid terms.
