1. The hearing has been conducted through Video Conferencing.
CRL.M.A. 11436/20212. This application is filed with following prayers :
"Pass an order thereby directing Commissioner, Delhi Police to monitor the investigation, ordered by this Hon'ble Court on 08.01.2021 and report be called under the signature of Joint Commissioner of Police, regarding investigation carried out by police officials of Police Station: Dwarka, after 08.01.2021 and/ or to transfer pending investigation to the CBI for further investigation as prayed in the original writ petition."
3. This application is for issuance of urgent directions. It is stated vide order dated 08.01.2021 it was directed the investigation may be carried out by an officer of the rank of an Inspector, who shall also consider the effect of discrepancies as alleged in para 5(i) to (xviii) of the petition. The laptop and mobile phone alongwith other articles were seized and sent to CFSL. It is submitted ASI Naresh, who was respondent No.3 in the earlier petition and against whom allegations were made, is still joining the Signature Not Verified Digitally Signed By:VIJAYA LAKSHMI DOBHAL Signing Date:28.07.2021 16:50 investigation and he is having duplicate key of the room where the deceased was last seen alive. Further the officer of the rank of Inspector is also not doing investigation in the present matter.

5. Let a reply be filed by the respondents on these two issues viz. a) as to if ASI Naresh is still joining the investigation; and b) if the investigation is not being carried by an officer of the rank of an Inspector before the next date of hearing with an advance copy to learned counsel for the petitioner and be placed on record as well.
