JUDGMENT
1. The writ petitioners have been filed by the petitioners who were initially engaged as temporary Pump Operators for a period of 179 days commencing from 10.09.2018 by the NIT, Calicut. Some of the petitioners were engaged way back in the years 2010 - 2015 in the same fashion.
2. In the year 2022, the University took a policy decision to take the temporary employees through outsourcing from manpower agencies. The petitioners got themselves enrolled with M/s. Private Eye. The petitioners got involved in the said manpower agency and they were employed through the said manpower agency in the respondent Institution. The respondent institution entered into the contract with the said manpower agency which got expired on 31.03.2024. The respondent Institution has engaged another manpower agency to supply manpower. As the petitioners' employment was through manpower agency from 2022, on conclusion of the contract 8 W.P. (C) Nos. 15306 of 2024, 8486 of 2019 and 15686 of 2020 2025:KER:51803 with M/s. Private Eye on 31.03.2024, the petitioners' employment also came to an end.
3. The petitioners have approached this Court in this writ petition claiming the relief that they should not be replaced by another set of temporary employees or ad hoc employees as there is no complaint against them.
4. Ms. Thulasi K. Raj, the learned Counsel appearing for the petitioners submits that the petitioners have worked for a long time;
some of them from 2010, some of them from 2015 and some of them from 2019 in the respondent Institution as direct employees and thereafter through manpower agency, after working so long, they have been thrown out mercilessly and they are not even allowed to participate on the contract employment on the condition that those who have put in more than five years in the Institution shall not be allowed to apply for contractual employment. She has also relied on a Judgment of the Hon'ble Supreme Court in the case of Jaggo v.
Union of India & others (2024 SCC OnLine SC 3826) to submit that using outsourcing as a shield is not permitted to a Institution/Government Agency or Government which perpetuates exploitation. She had pressed into service paragraphs 9 W.P. (C) Nos. 15306 of 2024, 8486 of 2019 and 15686 of 2020 2025:KER:51803 25, 26, 27 and 28 of the said Judgment in support of her contentions.
25. It is a disconcerting reality that temporary employees, particularly in government institutions, often face multifaceted forms of exploitation. While the foundational purpose of temporary contracts may have been to address short-term or seasonal needs, they have increasingly become a mechanism to evade long- term obligations owed to employees. These practices manifest in several ways:
• Misuse of "Temporary" Labels: Employees engaged for work that is essential, recurring, and integral to the functioning of an institution are often labeled as "temporary" or "contractual," even when their roles mirror those of regular employees. Such misclassification deprives workers of the dignity, security, and benefits that regular employees are entitled to, despite performing identical tasks. • Arbitrary Termination: Temporary employees are frequently dismissed without cause or notice, as seen in the present case. This practice undermines the principles of natural justice and subjects workers to a state of constant insecurity, regardless of the quality or duration of their service. • Lack of Career Progression: Temporary employees often find themselves excluded from opportunities for skill development, promotions, or incremental pay raises. They remain stagnant in their roles, creating a systemic disparity between them and their regular counterparts, despite their contributions being equally significant. • Using Outsourcing as a Shield: Institutions increasingly resort to outsourcing roles performed by temporary employees, effectively replacing one set of exploited workers with another. This practice not only perpetuates exploitation but also demonstrates a deliberate effort to bypass the obligation to offer regular employment. • Denial of Basic Rights and Benefits: Temporary employees are often denied fundamental benefits such as pension, provident fund, health insurance, and paid leave, even when their tenure spans decades. This lack of social security subjects them and their families to undue hardship, especially in cases of illness, retirement, or unforeseen 10 W.P. (C) Nos. 15306 of 2024, 8486 of 2019 and 15686 of 2020 2025:KER:51803 circumstances.
26. While the judgment in Uma Devi (supra) sought to curtail the practice of backdoor entries and ensure appointments adhered to constitutional principles, it is regrettable that its principles are often misinterpreted or misapplied to deny legitimate claims of long-serving employees. This judgment aimed to distinguish between "illegal" and "irregular" appointments. It categorically held that employees in irregular appointments, who were engaged in duly sanctioned posts and had served continuously for more than ten years, should be considered for regularization as a one-time measure. However, the laudable intent of the judgment is being subverted when institutions rely on its dicta to indiscriminately reject the claims of employees, even in cases where their appointments are not illegal, but merely lack adherence to procedural formalities. Government departments often cite the judgment in Uma Devi (supra) to argue that no vested right to regularization exists for temporary employees, overlooking the judgment's explicit acknowledgment of cases where regularization is appropriate. This selective application distorts the judgment's spirit and purpose, effectively weaponizing it against employees who have rendered indispensable services over decades.
27. In light of these considerations, in our opinion, it is imperative for government departments to lead by example in providing fair and stable employment. Engaging workers on a temporary basis for extended periods, especially when their roles are integral to the organization's functioning, not only contravenes international labour standards but also exposes the organization to legal challenges and undermines employee morale. By ensuring fair employment practices, government institutions can reduce the burden of unnecessary litigation, promote job security, and uphold the principles of justice and fairness that they are meant to embody. This approach aligns with international standards and sets a positive precedent for the private sector to follow, thereby contributing to the overall betterment of labour practices in the country.
28. In view of the above discussion and findings, the appeals are allowed. The impugned orders passed by the High Court 11 W.P. (C) Nos. 15306 of 2024, 8486 of 2019 and 15686 of 2020 2025:KER:51803 and the Tribunal are set aside and the original application is allowed to the following extent:
i. The termination orders dated 27.10.2018 are quashed;
ii. The appellants shall be taken back on duty forthwith and their services regularised forthwith. However, the appellants shall not be entitled to any pecuniary benefits/back wages for the period they have not worked for but would be entitled to continuity of services for the said period and the same would be counted for their post-retiral benefits.

On the other hand, Ms. Laya Mary Joseph, the learned Counsel representing the respondent Institution submits that after 2022, the petitioners are no longer in direct employment of the respondent Institution. The Muster Roll of M/s. Private Eye, the outsourcing agency would show that the petitioners are on contractual employment with the said outsourcing manpower agency and they were employed through that manpower agency up to year 2024, when the contract with the said manpower agency came to an end.
The submission is that there is no direct contract of employment with the Institution.
6. The facts as stated above are not under dispute. There is no denial that in the year 2022, the petitioners got employment as Pump Operators through the outsourcing manpower agency. There is no direct contract between the petitioners and the respondent 12 W.P. (C) Nos. 15306 of 2024, 8486 of 2019 and 15686 of 2020 2025:KER:51803 Institution providing the petitioners temporary employment in the Institution and, therefore, this Court cannot direct the respondent Institution to keep the petitioners on job when there is no direct employment contract between the petitioners and the respondent Institution.
7. However, considering the fact that the petitioners have worked for a long time and they are not permitted to apply for contractual employment in the respondent Institution on the condition that those who have worked for more than five years in the respondent Institution will not be permitted to apply for contractual employment. This condition appears to be totally illegal and arbitrary. The experience must be given some weightage and if the Institution is engaging another set of contractual employees, the weightage should be given to the petitioners like employees who have worked in the Institution for a substantial period and their experience must be counted and some weightage must be given.
Therefore, the condition of five-year bar is set aside and the respondent Institution is directed to grant weightage for the experience of working in the Institution to the petitioners and should be favourous to them while engaging the contractual employees in 13 W.P. (C) Nos. 15306 of 2024, 8486 of 2019 and 15686 of 2020 2025:KER:51803 the Institution. The respondent Institution also must impress on the new manpower agency to engage the petitioners.
With the aforesaid directions, the present writ petitions are hereby disposed of.
