The CPIO has provided incomplete information.3
Submissions made by Complainant and Respondent during Hearing:
The complainant alleged that he was given incomplete information. He submitted in each of the cases, the total affiliation orders were not given and instead partial information was given.
The CPIO submitted that proper information was given. However, as the complainant is claiming that complete affiliation orders were not given he can re-verify and provide the same.
Observations:
The CPIO vide written submissions dated 02.02.2022 submitted that the sought for information was given to the complainant vide e-mail dated 09.12.2021 and the same was acknowledged by the complainant. The acknowledgment could not be found on record, and therefore the complainant was asked during the hearing, to which he submitted that incomplete information was given. He further pressed for complete affiliation orders in this regard.
Decision:
The Commission noted that there was a one year delay in providing the information and hence, records a severe warning to the concerned CPIO. Moreover, as the complainant pressed for the information, as relief, the present complaints are converted into appeals u/s 19 of the RTI Act. The CPIO shall revisit the RTI applications vis-a-vis the documents available on each of the points and provide a revised point-wise information to the appellant for each of the above mentioned cases within 10 days from the date of receipt of this order.
The appeals are disposed of accordingly.
