Claiming himself to be a devotee of Bannari Amman at Bannari Amman Temple, Sathyamangalam, has filed the instant writ petition for a Mandamus directing respondents 1, 3, 6 10 & 11 respectively, to handover 10 hectare of land belonging to their department to and in favour of the 13th respondent department and to in favour of 6th respondent department, as per proceedings of 8th respondent, dated 18.06.2014, in R.C.No.14962/2014/E2, as well as, to consider his representation dated 03.12.2018.

On instructions and inviting the attention of this Court to the proceedings of the District Collector, Erode district in R.C.14962/2014/E2, dated 08.02.2019, Mr.Akhil Akbar Ali, learned Government Advocate, submitted that after the filing of the instant writ petition, a joint meeting was conducted by the District Collector, Erode district and a decision has been arrived at, thereby HR & CE Department will give 50 acres of land to the Revenue Department, which in turn will give 50 acres to the Forest Department and that the Forest Department will in turn give 25 acres of land to Bannari Amman Temple, Sathyamangalam.
5. Learned Government Advocate further submitted that directions have been issued to the Land Survey Department to measure and prepare a sketch of the land in Survey No.396/1 and submit the same to the District administration. It is also his contention that for exchange of lands HR & CE should provide guarantee. For brevity, the said proceedings dated 08.02.2019, is reproduced:

Mr.R.Marudhachalamurthy, learned counsel appearing on behalf of the petitioner submitted that though a similar decision was taken on 18.06.2014, by the District Collector, Erode district, http://www.judis.nic.in 11 no further action has been taken. Though there are no materials produced before this Court that the District Collector, Erode district has taken any decision in 2014, on the request, to handover 10 hectare of land to Bannari Amman Temple, Sathyamangalam, now, after a joint meeting, a decision has been taken to handover 25 acres to Bannari Amman Temple, Sathyamangalam. Modalities have also been framed. As huge extent of land have to be exchanged between the departments, a detail survey and measurements have to be made, which, certainly, requires time. Now that the District administration has taken a decision to allot lands after exchange of lands between the departments, the said exercise has to be completed as expeditiously as possible and by not later than four months from the date of receipt of a copy of this order. In case of any difficulty, it is open to the District administration to approach this Court for extension of time.
7. Instant writ petition is disposed of with the above observation. No costs.
