3. Scope and extent of application.
-These Regulations shall apply in all cases where tariff, for a generating station or a unit thereof based on renewable sources of energy, is to be determined by the Commission under Section 56 read with Section 71 of the Act.[Provided that in cases of wind, Small Hydro projects, Biomass power based on Rankine cycle, non-fossil fuel based cogeneration projects, Solar PV, Solar Thermal power projects, Biomass gasifier, Biogas, Municipal Solid Waste and Refuse Derived Fuel based power projects, these regulations shall apply subject to the fulfillment of eligibility criteria specified in Regulation 4 of these Regulations.] [Substituted by Notification No. 49-JKSERC of 2016, dated 22.3.2016 (w.e.f. 17.5.2013).]
