1. This civil writ petition has been filed under Articles 226 and 227 of the Constitution of India praying for issuance of a writ in the nature of certiorari quashing letter/advertisement dated 16.03.2012 (Annexure P-3) vide which Municipal Corporation, Ambala-respondent no. 3 has invited the tender for sanitation work and has demanded 550 sanitation workers.

According to the learned counsel, earlier 107 petitioners were working as sanitation workers under Municipal Council, Ambala from the year 2002 and now all the petitioners are working with respondent no. 3 on daily wages w.e.f. February, 2011. A prohibition of employment of contract labour in respect of sanitation work in the Municipal Corporation has been sought. It is urged that Section 10 of the Contract Labour (Regulation and Abolition) Act. 1970 prohibits engagement of contract labour.

3. Learned counsel for the petitioners submits that representation dated 17.03.2012 (Annexure P-4) has been submitted to respondent no. 1, CWP No. 8849 of 2012 2 on which, no decision has been taken so far.

4. After hearing learned counsel for the petitioners, perusing the record and without expressing opinion on the merits of the case, the writ petition is disposed of by directing respondent no. 1 or any officer duly authorized by respondent no. 1 to take a decision on the representation (Annexure P-4) within four weeks from the date of receipt of certified copy of the order by passing a speaking order in accordance with law.
