Ms. Harvinder Kaur Oberoi, Member (J) Since all the above-captioned Original Applications involve common questions of law and fact arising out of the same recruitment process of the Respondent, they were heard together. For the sake of convenience, OA No. 4210/2024 has been treated as the leading case, as the issues raised therein comprehensively cover the subject matter of the connected OAs. 2. The Council of Scientific and Industrial Research, under the Department of Scientific and Industrial Research, Ministry of Science and Technology, Government of India, issued Advertisement No. E-
1/RC/2023/1 for the Combined Administrative Services Examination -
2023 (CASE-2023), for direct recruitment to the posts of Section Officer and Assistant Section Officer. As per the advertisement the start date for filling the application form was 08.12.2023 and the last date for filing the form was 12.01.2024.

3. Applicants are aspirants for the post of SO and ASO. They had applied pursuant to the notification and had participated in the recruitment exercise. The exercise consists of Stage-I and Stage -II. The advertisement stated the tentative date of stage -I examination as February 2024. On 17.01.2024 the dates for Stage -I examination for SO and ASO were announced. The examinations were scheduled from 05.02.2024 to 20.02.2024. Stage-I of the Examination consisted of Paper-I and Paper-II, both being computer based examinations.

4. The applicants were shortlisted for Stage-II. Stage -II examination was scheduled to be conducted on 07.07.2024.
5. On 28.06.2024 a notice was published prescribing minimum threshold marks for Paper-III of Stage-II. Applicants are aggrieved of this notice. The applicants appeared on Paper-III, however when they were not shortlisted for the next stage they have approached this Tribunal.
5.1. Learned counsel for the applicants submits that the factual implication of the manifestly arbitrary change introduced mid-way by the Respondent before the Paper-III, descriptive examination is that the applicants, who had scored marks well above the final cut-off in the aggregate out of 500, have been arbitrarily excluded from selection 49 Item No.36/C-4 O.A. (i) Candidates who secure the minimum threshold marks in aggregate out of 350 marks (Paper-I and Paper -11) will be called for Paper-III (Descriptive Paper).
(ii) Candidates who secure the minimum threshold marks in Paper-I, Paper-II and Paper-III in aggregate out of 500 marks will be called for Interview. Interview carries 100 marks
(iii) The total marks for the post of Section Officer (Gen/F&A/S&P) will be 600.
(iv) Final Select/Wait List will be prepared keeping in view the number of vacancies and total marks obtained by the candidates, subject to securing the minimum threshold marks.
For the post of Assistant Section Officer (Gen/F&A/S&P) only:-
(i) Candidates who secure the minimum threshold marks in aggregate out of 350 marks (Paper-I and Paper -II) will be called for Paper-III (Descriptive Paper) and Computer Proficiency Test (CPT). CPT is Qualifying in nature and Marks obtained in CPT will not be counted towards final marks.
(ii) The total marks for the post of Assistant Section Officer (Gen/F&A/S&P) wiil be 500, excluding CPT.
(iii) Final Select/Wait List will be prepared keeping in view the number of vacancies and total marks obtained by the candidates, subject to securing the minimum threshold marks and qualifying marks in CPT.

Learned counsel for the applicant stated that but for the said illegal and arbitrary imposition, the applicants would have otherwise stood selected based on merit and in accordance with the examination scheme laid down in the advertisement.

Learned counsel for the applicant stated that the respondents' reliance on the impugned Notification dated 28.06.2024 to justify the introduction of minimum threshold marks for Paper-III (Descriptive) is wholly untenable in law. The said impugned notification which has been challenged by the applicant is reads as under:-
"Sub: Declaration of minimum threshold marks for Paper-III of Stage-II in Combined Administrative Services Examination (CASE-2023) for recruitment of SOs and ASOs-reg.
This is for the information of all those candidates who have been shortlisted for the Stage-II Examination of CSIR CASE -2023 and 53 Item No.36/C-4 O.A. No. 4210/2024 O.A. No. 4950/2024 O.A. In the Advertisement no E- I/RC/2023/1, para 5-A "Scheme of Examination" it is mentioned that Minimum threshold marks, wherever prescribed/required will be decided by the Competent Authority and Final Select/Wait List will be prepared keeping in view the number of vacancies and total marks obtained by the candidates, subject to securing the minimum threshold marks and qualifying marks in Computer P'roficiency Test (CPT).
The job profile and position of Section Officer and Assistant Section Officers in CSIR extensively requires the noting & drafting skills and keeping these aspects in view, there is a provision of descriptive paper consisting of Essay, Precis and Letter / Application Writing, carrying a total of 150 marks. Keeping in view the job profile of Section Officer/Assistant Section Officers in CSIR and in order to maintain the efficiency in day-to-day office work, minimum threshold marks for Paper III of Stage-II Examination in Combined Administrative Services Examination (CSIR CASE-2023) for recruitment of SOs and ASOs has been decided by the Competent Authority, as under:

The learned counsel for the applicant stated that the advertisement dated 08.12.2023, which formed the basis of the recruitment process, stipulated the examination scheme for the post of SO, as per which the candidate who secures minimum threshold marks in Paper-I, Paper-II and paper-III in aggregate out of 500 marks will be called for interview. Interview carries 100 marks. For Assistant Section Officer (ASO) the procees was slightly different, however the same was prescribed in a complete, clear, and unambiguous manner. No. 182/2025 said scheme, the final Select/Waitlist was to be prepared based on the total aggregate marks in Paper-I, Paper-II, and Paper-III (Descriptive), subject to the candidate securing minimum threshold marks in Stage-I (Paper-I + Paper-II) and qualifying the CPT. The CPT was laid down to be only of qualifying nature and not to be counted towards merit.
7.1. The belated introduction of a separate minimum qualifying score for Paper-III by way of the Notification dated 28.06.2024 is an act of changing the selection criteria mid-process and is contrary to the settled law as laid down by the Hon'ble Supreme Court in Tej Prakash Pathak and Ors. v. Rajasthan High Court and Ors., (2025) 2 SCC 1.

Learned counsel for the applicants stated that the advertisement did not prescribe any minimum qualifying marks for Paper-III for recruitment of SO and ASO, nor did it reserve any discretion for the 56 Item No.36/C-4 O.A. No. 458/2025 O.A. No. 456/2025 O.A. No. 472/2025 O.A. No. 889/2025 O.A. No. 455/2025 O.A. No. 4312/2024 O.A. No. 4231/2024 O.A. No. 4913/2024 O.A. No. 4407/2024 O.A. No. 182/2025 Respondent to make such prescription at a later stage. On the contrary, it clearly demarcated the threshold criteria as applicable only to Stage-I. Hence, no such discretion could have been assumed or exercised. The Respondents' erroneous reliance on the clause "Minimum threshold marks, wherever prescribed/required, will be decided by the Competent Authority" is misconceived.
9. The learned counsel for the applicants stated that this clause must be interpreted in light of the express and specific stipulations within the Advertisement. A plain reading of the Scheme of Examination, as set out in the Advertisement dated 08.12.2023, evinces that the requirement of minimum threshold marks was confined to Stage-I alone. No such prescription was contemplated for Paper-III, either explicitly or impliedly. He further submits that the Hon'ble 57 Item No.36/C-4 O.A. No. 4210/2024 O.A. No. 4950/2024 O.A. No. 472/2025 O.A. No. 889/2025 O.A. No. 455/2025 O.A. No. 4312/2024 O.A. No. 4231/2024 O.A. No. 4913/2024 O.A. No. 4407/2024 O.A. No. 182/2025 Constitution Bench of the Supreme Court in Tej Prakash Pathak & Ors.
v. Rajasthan High Court & Ors. (supra) has categorically held that the rules of the game cannot be changed after the game has begun. In the present case, the examination process commenced in December 2023 with the publication of the advertisement, and the impugned notification altering the selection criteria was issued in June 2024, after candidates had already undertaken and completed Stage-I of the examination in accordance with the original terms. Therefore, the impugned Notification dated 28.06.2024 is violative of Article 14 of the Constitution of India, the doctrine of legitimate expectations, and the principles of fairness and transparency in public employment.
10. In view of the above, learned counsel for the applicants stated that the argument of the respondent, seeking to justify the Notification 58 Item No.36/C-4 O.A. No. 4210/2024 O.A. No. 456/2025 O.A. No. 472/2025 O.A. No. 889/2025 O.A. No. 455/2025 O.A. No. 4312/2024 O.A. No. 4231/2024 O.A. No. 4913/2024 O.A. No. 4407/2024 O.A. No. 182/2025 dated 28.06.2024 as within their discretionary domain, is unsustainable in law and liable to be rejected. The said notification, having altered the selection process retrospectively, deserves to be set aside as violative of the principles of natural justice, settled law, and the rights of the Applicants under Articles 14 and 16 of the Constitution of India.

12. During the course of hearing, the Respondent raised an objection that the Applicants had failed to implead the successful candidates in the pending Original Applications (OAs).
13. The learned counsel for the applicants stated that vide order dated 14.01.2025 passed in OA No. 182 of 2025, this Tribunal directed the Applicants to implead the successful candidates. In compliance with the said direction, the Applicants filed Miscellaneous Application No. 595 of 2025, seeking leave to implead the successful candidates as necessary parties to the proceedings. Pursuant thereto, the Applicants effected service on the successful candidates through publication in a widely circulated newspaper. An Affidavit of Service dated 05.04.2025 was duly filed before this Hon'ble Tribunal, evidencing compliance with the directions of this Tribunal.

14. Learned counsel for the respondents vehemently opposed the contentions made by the applicants. The respondents have heavily relied upon the advertisement, submitting that CSIR had, in the advertisement itself, reserved the right to prescribe minimum threshold marks wherever required. The respondents further relied upon the counter reply filed by them, which reads as under
"3.5 The recruitment process involves examination at Stage- 1, covering Paper-I and Paper-II for all candidates, which is a Computer Based Test (CBT), Stage-II covering Paper-III and Computer Proficiency Test (for the post of ASO only) and Interview (for the post of SO only). The Stage - 1 Examination under CSIR CASE-2023 was conducted from 05.02.2024 to 20.02.2024.
3.6 That more than 4.75 Lacs candidates applied for these posts within the prescribed period and were issued admit cards. The Stage-1 Examination under CSIR CASE-2023 was scheduled in 19 major cities all over India, with 138 examination venues.61

No. 182/2025 3.7 The answering respondent issued the Notice No. 3- 2(a)/2023-E. I (RC) dated 03.06.2024 whereby answering respondent declared the result of the Combined Administrative Service Examination (CSIR CASE-2023) Stage I and also provided the threshold and cut off marks out of 350.
3.8 The answering respondent further issued the Notice dated 21.06.2024 whereby providing the schedule of the Stage-II Examination (Paper-III and CPT) which was to be held on 07.07.2024 and downloading of Admit Cards in the present selection process and provided the details of the above said examination.
3.9 The answering respondent vide Notice no. 3-2(a)/2023- E. I(RC) dated 28.06.2024 declared the minimum threshold marks for Paper-III of Stage-II in CSIR Combined Administrative Service Examination (CSIR CASE-2023) in the present selection process. The said notice was issued before the commencement of Paper-III examination and it was in accordance with scheme of examination mentioned in advertisement of CSIR CASE-2023 and functional requirement of the organization from such post. 3.12 The Answering Respondent issued the notice dated 02.10.2024 whereby the Answering Respondent provided the schedule of the interview process and the candidates called for the Interview for the post of SO in the present selection process. The Answering Respondent also issued the list of shortlisted candidates for interview for the post of SO in the present selection process who secured the minimum threshold marks in Paper-1 Paper-Il and Paper-
III in aggregate out of 500 marks and subject to securing the notified minimum threshold marks in Paper-III. It is pertinent to mention here that this was in terms of the 63 Item No.36/C-4 O.A. It is pertinent to mention here that none of the Applicants found place in the list of shortlisted candidates called for interview. That a total of 191 candidates had been called for interview held during 25.10.24 to 29.10.24.
3.16 That the final result of CSIR Combined Administrative Services Examination (CSIR CASE-2023) has been declared vide Notice dated 02.01.2025, along with list of candidates empaneled for the post of SO and ASO.

The main grievance of the applicants in the present O.A. is that impugned order dated 28.06.2024 which prescribed minimum threshold marks for Paper III of Stage-II in CSIR Combined Administrative Service Examination (CSIR CASE-2023) is allegedly in violation of the Examination Scheme as laid down in the initial advertisement.
4. That it is pertinent to mention here that the Applicants never challenged the aforesaid notification dated 28.06.2024 providing for the Minimum Qualifying marks and in fact readily appeared in the Paper-III Exam held on 07.07.2024 and having not qualified the same sought to challenge it vide the present O.A. The applicants, therefore having participated in the process i.e. Paper-III without any demur or protest, cannot be allowed to turn round and question the very same process having failed to qualify.
5 That thus the applicants are estopped from contending that the Notification dated 28.06.2024 was faulty or not in terms of the initial advertisement. It is a matter of record that the applicants appeared in the Paper-III held on 07.07.2024 and it was only when they failed to qualify and did not find their name in the interview list issued vide Notice dated 02.10.2024, that the present O.A. came to be filed.

6. That even on merits, the argument of the applicants is unmerited and baseless. The advertisement clearly provided under para 5-A "Scheme of Examination", wherein it is mentioned that "Paper-1, Paper-II and Paper-III will be common and compulsory for all the posts. Minimum threshold marks, wherever prescribed/required will be decided by the Competent Authority. Final Select/ Wait List will be prepared keeping in view the number of vacancies and total marks obtained by the candidates, subject to securing the minimum threshold marks".

The Advertisement very categorically provided that the decision of the Answering Respondent in all matters relating to eligibility, acceptance or rejection of application as well as mode of selection will be final and binding on the candidates. The advertisement clearly provided that the Answering Respondent could earmark the minimum threshold marks and in light of the same the Answering Respondent vide Notice no. 2(a)/2023-E.I(RC) dated 28.06.2024 declared the minimum threshold marks for Paper-III of Stage-II in CSIR Combined Administrative Service Examination (CSIR CASE-2023) in the present selection process.
8 That further, advertisement itself also granted the power to the Answering Respondent to issue corrigendum/addendum to the recruitment drive and 66 Item No.36/C-4 O.A. No. 4210/2024 O.A. No. 456/2025 O.A. No. 472/2025 O.A. No. 889/2025 O.A. No. 455/2025 O.A. No. 4312/2024 O.A. No. 4231/2024 O.A. No. 4913/2024 O.A. No. 4407/2024 O.A. No. 182/2025 therefore everything was done in terms of the advertisement.
9. It is no more res integra that a public authority has the discretion to exercise the full range of choices available within its executive power. The public authority often has to take into consideration diverse factors, concerns, and interests before arriving at a particular policy decision. The courts are generally cautious in interfering with a bona fide decision of public authorities provided such a decision is taken in the larger public interest.
10. It is pertinent to mention here that the job profile and position of Section Officer and Assistant Section Officer in CSIR extensively requires the Noting and Drafting Skills and keeping these aspects in view, there is a provision of descriptive paper (Paper III) consisting of Essay, Precis and Letter/Application Writing, carrying a total of 150 marks.

Phat keeping in view the job profile of Section Officer / Assistant Section Officer in CSIR and in order to maintain the efficiency in day-to-day office work, minimum threshold marks for Paper-III of Stage-II Examination in CSIR Combined Administrative Services Examination (CSIR CASE 2023) for recruitment of SO and ASO has been decided by the Competent Authority. The same was notified to all the candidates on 28.06.2024 before the 67 Item No.36/C-4 O.A. No. 4210/2024 O.A. No. 4950/2024 O.A. No. 4902/2024 O.A. No. 142/2025 O.A. No. 166/2025 O.A. No. 334/2025 O.A. No. 850/2025 O.A. No. 173/2025 O.A. No. 4802/2024 O.A. No. 2579/2025 O.A. No. 458/2025 O.A. No. 456/2025 O.A. No. 472/2025 O.A. No. 889/2025 O.A. No. 455/2025 O.A. No. 4312/2024 O.A. No. 4231/2024 O.A. No. 4913/2024 O.A. No. 4407/2024 O.A. No. 182/2025 scheduled date of holding examination of Paper-Ill on 07.07.2024 and thus there is no arbitrariness or illegality in providing for the minimum qualifying marks and the same was done in the larger public interest.
14.1. The respondents also contended that the applicants, having appeared in Paper-III without demur or protest, are estopped from challenging the prescription of threshold marks after having failed to qualify. In support of this submission, reliance has been placed upon a catena of judgments wherein it has been consistently held that once a candidate has participated in a selection process without objection, he cannot subsequently turn around and challenge the process upon being unsuccessful.
14.2 In this regard, reliance is placed on the judgment of the Hon'ble Supreme Court in Jharkhand Public Service Commission v. Manoj Kumar Gupta & Anr., (2019) 20 SCC 178, wherein it was held that a 68 Item No.36/C-4 O.A. No. 4210/2024 O.A. No. 4950/2024 O.A. No. 4902/2024 O.A. No. 142/2025 O.A. No. 166/2025 O.A. No. 334/2025 O.A. No. 850/2025 O.A. No. 173/2025 O.A. No. 4802/2024 O.A. No. 2579/2025 O.A. No. 458/2025 O.A. No. 456/2025 O.A. No. 472/2025 O.A. No. 889/2025 O.A. No. 455/2025 O.A. No. 4312/2024 O.A. No. 4231/2024 O.A. No. 4913/2024 O.A. No. 4407/2024 O.A. No. 182/2025 candidate cannot approbate and reprobate by first participating in a recruitment process and then disputing its validity upon failure.
Similarly, reliance is placed on Ram Sharna Maurya & Ors. v. State of U.P. & Ors., (2021) 15 SCC 401, where the Apex Court reiterated that a challenge after participation is barred. Further reliance is placed on Dr. Hareesh N. Ramanathan v. Cochin University of Science & Technology & Anr., 2020 SCC OnLine Ker 19467, where the Kerala High Court held in the same vein that acquiescence to the process disentitles a candidate from later questioning its validity.
15. Heard the learned counsel for the parties and perused the records.

The grievance of the Applicants is directed against the Notification dated 28.06.2024 issued by the Respondent prescribing minimum threshold marks for Paper-III (Descriptive) in the Combined 69 Item No.36/C-4 O.A. No. 4210/2024 O.A. No. 4950/2024 O.A. No. 4902/2024 O.A. No. 142/2025 O.A. No. 166/2025 O.A. No. 334/2025 O.A. No. 850/2025 O.A. No. 173/2025 O.A. No. 4802/2024 O.A. No. 2579/2025 O.A. No. 458/2025 O.A. No. 456/2025 O.A. No. 472/2025 O.A. No. 889/2025 O.A. No. 455/2025 O.A. No. 4312/2024 O.A. No. 4231/2024 O.A. No. 4913/2024 O.A. No. 4407/2024 O.A. No. 182/2025 Administrative Services Examination - 2023. The contention urged is that the said prescription was introduced midway and is contrary to the original Advertisement dated 08.12.2023.

On consideration of the submissions and material placed on record, it is evident that the Advertisement dated 08.12.2023 itself specifically provided that "minimum threshold marks, wherever prescribed/required, will be decided by the Competent Authority" and further clarified that the process indicated was "suggestive only" and subject to the final decision of the Competent Authority keeping in view the mode of examination and logistics. Thus, the discretion to prescribe threshold marks was expressly reserved in the recruitment notification itself.
18. In these circumstances, the prescription of minimum qualifying marks for Paper-III by Notification dated 28.06.2024 cannot be held to 70 Item No.36/C-4 O.A. No. 4210/2024 O.A. No. 4950/2024 O.A. No. 4902/2024 O.A. No. 142/2025 O.A. No. 166/2025 O.A. No. 334/2025 O.A. No. 850/2025 O.A. No. 173/2025 O.A. No. 4802/2024 O.A. No. 2579/2025 O.A. No. 458/2025 O.A. No. 456/2025 O.A. No. 472/2025 O.A. No. 889/2025 O.A. No. 455/2025 O.A. No. 4312/2024 O.A. No. 4231/2024 O.A. No. 4913/2024 O.A. No. 4407/2024 O.A. No. 182/2025 be illegal or arbitrary. The reliance placed by the Applicants on the judgment of the Hon'ble Supreme Court in Tej Prakash Pathak & Ors.
v. Rajasthan High Court & Ors. (2025) 2 SCC 1 is misplaced, inasmuch as in the present case the enabling clause was part of the initial recruitment scheme.
19. Further, the Hon'ble High Court of Bombay in Sharad & Ors. v.
State of Maharashtra & Ors., (2025) SCC Online Bom 253 Writ Petition No. 7267/2024 has reiterated that where the terms of recruitment specifically reserve a discretion to the recruiting authority to prescribe or modify threshold marks in the interest of maintaining standards of service, such prescription cannot be faulted, provided it is applied uniformly and notified prior to the examination. The ratio of the said judgment directly supports the stand taken by the Respondent herein.

20. Likewise, in Sarika v. DSSSB, (2025) SCC online Del 1052 WP (C) 13658/2018 the Hon'ble High Court of Delhi held that the prescription of minimum qualifying marks at an intermediate stage of the examination process, when backed by an express enabling clause in the advertisement, does not amount to changing the "rules of the game"
midstream. The Court further held that candidates who participate in such examination without protest are estopped from challenging the same at a later stage. The facts of the present case are on all fours with the said pronouncement.

Accordingly, in view of the express terms of the advertisement, and in light of the authoritative pronouncements of the Hon'ble Supreme Court in Sharad (supra) and Sarika (supra), we are of the considered 72 Item No.36/C-4 O.A.
