Section 226(4) in The Maharashtra Municipal Corporations Act, 1949
(4)If any such structure or fixture as is described in sub-section (1) has been erected, set-up, added to, or placed against or in front of any premises at any time before the first day of April 1901, the Commissioner may give notice as aforesaid to the owner or occupier of the said premises :Provided that if in any such case the structure or fixture was lawfully erected, set-up, added to or placed, compensation shall be paid by the Commissioner to every person who sustains loss or damage by the removal or alteration thereof.
