Section 353A in Tamil Nadu District Municipalities Act, 1920
353A. [ Sanction for prosecution of chairman, councillor or executive authority. [This section was inserted by section 143 of the Tamil Nadu District Municipalities (Amendment) Act, 1930 (Tamil Nadu Act X of 1930).]
- When the [chairman, any councillor or the executive authority] is accused of any offence alleged to have been committed by him while acting or purporting to act in the discharge of his official duty, no Court shall take cognizance of such offence except with the previous sanction of the [State Government] [The word 'Provincial Government' were substituted for the word 'Local Government' by the Adaptation Order of 1937 and the word 'State' was substituted for 'Provincial' by the Adaptation Order of 1950.].]
