Information sought:
The Appellant filed an RTI application dated 01.04.2024 seeking the following information:
"The certified true copy of the:
a) Certified Information regarding the contract wise final executed and contract quantities for following items
i) Supply and fix three track sliding window with two or more shutter with 4mm thick plain/tinted as approved glass, one shutter using stainless steel wire. Cloth 0.36 MM nominal dia and 1.18 MM width aperture for mosquito proofing with good quality bearing handle lock.
Rubber Beading and glazing Clips etc using following aluminium powder coated sections confirming to. Catalogue of Jindal or equivalent make complete all as specified and directed by engineer in charge.
ii) Non skid ceramic tiles. 7to8 MM thick. (Square/rectangular). Area of each tile, exceeding 0.06 square metre but not exceeding 0.11 square metre in floors etc. Set and jointed in neat cement slurry, and pointed in white or coloured cement to match.

CPIO furnished a reply to the appellant dated 19.04.2024 stating as under:
" As per the section-8(1)(i) of RTi Act-2008, information which relates to personal information the disclosure of which has no relationship to any public activity or interest which would cause Page 4 of 12 unwarranted invasion of the privacy, if the individual cannot be furnished under the RTI Act. Since, the information (i.e. Details of the BoQ/ Contract agreements of other contractors) sought for in your ibid RTI application is related to personal information of other parties (Contractors) & does not serve any public interest hence this office is unable to provide the same without obtaining their consent".
Being dissatisfied, the appellant filed First Appeal dated 27.04.2024 and FAA vide order dated 20.05.2024 stated as under:
"Undersigned has gone through the details & heard the version of appellant as well as CPIO.
Accordingly, undersigned is of the opinion that the reply provided by CPIO vide letter under reference are not as per RTI Act 2005. Hence, CPIO is being directed to provide fresh reply to the applicant complying all provisions of RTI".
CPIO in compliance of FAA order, vide letter dated 10.06.2024 stated as under:
"It is intimated that, contracts concluded in MES post 2014 are available in public domain, accordingly the various items as asked by you are already in public domain and you have also collected the same from interned only. Further in this regard it is submitted that as per RTI Act, CPIO is not supposed to create any data base for providing info to the applicant, thus said information as appealed by you is not available in the from as asked by you. Hence information cannot be provided."
Being dissatisfied the appellant again filed an appeal dated 18.06.2024 on which FAA vide order dated 22.06.2024 respondent as under:
"Undersigned has already clarified the subject matter vide this office letter under reference at para 1 ( C) above. However, the same has not been referred by you.
Though as per RTI Act 2005 there is no provision of 2nd appeal to FAA, still CPIO is being directed to provide information available as per section 2(f) of RTI Act 2005 to you by 30.01.2004 by email as well as speed post."
CPIO incompliance vide letter dated 27.06.2024 stated as under:

It is intimated that information asked by him is not maintained in the form as desired and is voluminous in nature. In view of above, you are requested to visit AGE B/R-I (S) Pune office on 4.7.2024 between 0900 hrs to 1100 hrs and take photcopy of desired documents available after paying a prescribed fees as per RTI Act 2005.
Feeling aggrieved and dissatisfied, Appellant approached the Commission with the instant Second Appeal.
2. Second Appeal- CIC/MESER/A/2024/123412 Information sought:
The Appellant filed an RTI application dated 20.03.2024 seeking the information:
" a) Certified Information regarding the contract wise final executed and contract quantities for following items:-

CPIO furnished a reply to the appellant dated 19.04.2024 stated as under:

Being dissatisfied, the appellant filed a First Appeal dated 26.04.2024. and FAA vide order dated 20.05.2024 stated as under:

3. Proof of having served a copy of Second Appeals on Respondent, while filing the same in CIC, is not available on record
4. The Appellant inter alia submitted that he filed two RTI applications dated 20.03.2024 and 01.04.2024 seeking certified information regarding contract-wise final executed quantities and contract quantities for specified items under various BOQs and tender IDs. With respect to both RTI applications he submitted that respondent CPIO had wrongly denied the information by invoking Section 8(1)(i) of the RTI Act. He further submitted that he is a contractor in the same department and the information sought pertains to only BOQ number and name of work only.
He further submitted that Section 8(1)(i) RTI Act is wrongly invoked.
5. Respondent while defending their case inter alia submitted that the Section 8(1)(i) of RTI Act was wrongfully invoked by the then CPIO. However, the sought information falls under section 8(1)(d) of RTI Act as it relates to commercial confidence, trade secrets and contractual details of third-party contractors. Disclosure of such information, according to the Respondent, may harm the competitive position of third parties.
Decision:

The Commission after adverting to the facts and circumstances of the case, hearing both the parties and perusal of the records, notes that the initial denial of information was made under Section 8(1)(i) of the RTI Act, which is clearly inapplicable to the present matter. The Respondent has admitted during the hearing that the said exemption was wrongly invoked.
The Respondent has now contended that the exemption applicable is Section 8(1)(d) of the RTI Act, which pertains to information including commercial confidence, trade secrets or intellectual property, the disclosure of which would harm the competitive position of a third party, unless larger public interest justifies disclosure.
Based on the facts placed on record, the Commission directs the Respondent CPIO to re-examine both RTI applications dated 20.03.2024 and 01.04.2024 and provide a revised reply strictly in accordance with the provisions of the RTI Act, 2005, within a period of 30 days from the date of receipt of this order, under intimation to the Commission. In case any Page 11 of 12 part of the sought information falls under exemption, then the CPIO shall correctly specify the specific sub-section under Section 8(1) of the RTI Act, 2005. FAA shall ensure compliance to this order.
With the above observations and directions, the appeal is disposed of.
