Section 5 in The Bihar Maintenance of Public Order Act, 1949

5. [ Grounds of order under sub-section (1) of Section 2 to be disclosed to person affected by the order. [Substituted by Bihar Act 6 of 1951, for the original Section.]

(1)Where an order is made in respect of any person under sub-section (1) of Section 2, within fifteen days of the date on which the order is served on the person in respect of whom it is made, the State Government shall communicate to the person affected thereby, as far as such communication can be made without disclosing facts which the State Government considers it would be against the public interest to disclose the grounds on which the order has been made against him and such other particulars as are in the opinion of the State Government sufficient to enable him to make, if he wishes, a representation against the order and such person may make a representation in writing to the State Government against the order and it shall be the duty of the State Government to inform such person of his right of making such representation and to afford him the earliest practicable opportunity of doing so.
(2)Communication of the grounds on which the order has been made shall be made by delivering or tendering a copy thereof to the person affected by the order.]
