Section 77(1) in The Karnataka Prohibition Act, 1961
(1)Whoever being the owner or occupier or having the use or care or management or control of any place, knowingly permits it to be used for the purpose of commission by any other person of any offence punishable under this Act, shall, on conviction, be punished with imprisonment for a term, which may extend to six months or with fine which may extend to one thousand rupees, or with both:Provided that in the absence of special and adequate reasons to the contrary to be mentioned in the judgment of the Court, such imprisonment shall not be less than three months and fine shall not be less than five hundred rupees.
