Counsel for the defendants seek further time to file written statement(s). Let written statement(s) be filed within 30 days along with affidavit of admission/denial of documents filed by the plaintiff.

Replication(s) to the written statement(s) be filed within 30 days thereafter along with affidavit of admission/denial of documents filed by the defendants.

List before the learned Joint Registrar for completion of pleadings and for marking of exhibits on 19th October 2022.

List before court on 09th December 2022.

CS(OS) 344/2019 Learned counsel appearing for the plaintiffs submits that defendants have not complied with orders dated 24.02.2020 and 24.08.2020, whereby they were directed to pay costs.

Let costs be paid within 02 weeks. Proof of payment of costs be placed on record.

Learned counsel for the plaintiffs also points-out that the defendants have not filed their reply to I.A. No 12186/2020 under Order XII Rule 6 of the Code of Civil Procedure 1908 despite notice having been issued on 17.12.2020.

Let reply be filed positively within 04 weeks; rejoinder thereto, if any, be filed within 03 weeks thereafter; with copies to the opposing counsel. It is made clear that if no reply is filed, the application will be decided on its merits without giving any further opportunity for filing reply.
