Section 39(3) in The Bengal Money-Lenders Act, 1940
(3)Notwithstanding any agreement between the parties, when the borrower has deposited in Court under this section any sum due in respect of the loan, if such sum is in payment of the principal or any part thereof, the interest on such principal or part shall cease from the date of service of notice on the lender under sub-section (2).
