                  WRIT PETITION No. 1126 of 2024

ORDER:

The grievance of the petitioners is non disposal of Petition filed by them vide RCB No.401/2021, dated 04.02.2022 by the 5 th respondent- Tahsildar.

2. Heard Sri N.Ramesh, learned counsel for the petitioners and Sri Dilip Naik, learned Assistant Government Pleader for Revenue.

Sri N.Ramesh, learned counsel for the petitioners, in elaboration would submit that, upon noticing that the 5th respondent-Tahsildar had mutated the name of one Madam Elishamma in the revenue records in relation to the joint family property of the petitioners without issuing any notice, the petitioners filed a petition under Section 5(A) of the Andhra Pradesh Rights in Land and Pattadar Pass Books ACT, 1971, which was numbered as RCB NO.401/2021. Though notices were issued pursuant to the said petition, the 5th respondent did not dispose of the same so far. Hence, the present writ petition is filed and prayed to allow the same directing the authorities to dispose of the said petition by fixing a time frame.

4. Sri Dilip Naik, learned Assistant Government Pleader for Revenue, by placing on record the written instructions dated 12.01.2024 submitted that the authorities would dispose of the petition/ROR case filed by the petitioner on top priority basis and sought three (03) months time for disposal.

5. The learned counsel for the petitioner reported no objection for granting three (03) months time to the authority for disposal of the ROR case as sought by the learned Assistant Government Pleader.

6. In view of the submissions made by the learned Assistant Government Pleader for Revenue that the ROR case of the petitioner would be disposed of by the authority within three (03) months and as the learned counsel for the petitioner reported no objection for granting the time as sought by the learned Assistant Government Pleader, nothing remains for adjudication in this writ petition. Therefore, this writ petition can be disposed of.

7. Accordingly, the writ petition is disposed of, directing the authority to dispose of the ROR case/petition filed by the petitioner within RC,J W.P.No.1126 of 2024 3 a period of three (03) months from the date of receipt of copy of this order. There shall be no order as to costs.

As a sequel, Interlocutory Applications, pending if any, shall stand closed and interim orders, if any, shall stand vacated.
