Shri S.K. Jain, learned counsel for respondent No.2. Learned counsel for appellant to assail the impugned order herein relies upon Single Bench interlocutory orders passed on 07.07.2021 [WP.11697.2021-Dharmendra Singh Chauhan & Anr. Vs. State of M.P. & Anr.] and 08.07.2021 (WP.11113.2021-Jaswant Singh Dangi Vs. The State of Madhya Pradesh & Ors.) both of which according to the petitioner are attended with similar circumstances as prevailing in the present case.
This Court is afraid that appellant cannot be helped. The petition in question has been dismissed by relying upon Single Bench decision which dismissed a similar case at the principal seat at Jabalpur in WP.11977/2021 and WP.11356/2021 but the said issue has earlier been decided by the co-ordinate Bench in WP.1673/2016 [Himanshi Deshmukh & Anr. Vs. State of M.P. & Ors.] and in Bindu Patel Vs. State of M.P. and another [2010 (4) MPLJ 231] and also by the Apex Court in Union of India & Others Vs. Shivbachan Rai [(2001) 9 SCC 356]".
The aforesaid fact is not disputed by learned counsel for appellant. Accordingly, reliance placed by learned counsel for appellant on the orders dated 07.07.2021 [WP.11697.2021-Dharmendra Singh Chauhan & Anr. Vs. State of M.P. & Anr.] and 08.07.2021 (WP.11113.2021-Jaswant Singh Dangi Vs. The State of Madhya Pradesh & Ors.) is of no avail.
Consequently, present appeal stands dismissed.
