O R D E R (ORAL)
As per: Ajay Pratap Singh, Member (Judicial) M.A./1752/2025 - Application for joining together.
Present O.A. has been filed by 52 applicants seeking seniority against common cause of action and seeking common reliefs.
2. In view of averments made in the M.A., present M.A. for joining together stands allowed and disposed of. Applicants are allowed to contest the case in single O.A. O.A./1528/2025
3. The applicants are working as Enforcement Officers/Accounts Officers with the Employees' Provident Fund Organization, have filed present O.A. invoking jurisdiction of this Tribunal under Section 19 of Administrative Tribunals Act, 1985, seeking following main relief(s) (as extracted from the O.A.) reads as under:-
"8.1. Direct the Respondent No. 3 to decide the pending representations submitted by the Applicant and pass a Reasoned Order on the representations made by the Applicants; 8.2. Direct the Respondent No. 3 to issue the Final Seniority List only after considering the Representations and grievances raised in the present Petition in a time bound manner; 8.3. Grant any such other and further relief as this Hon'ble Tribunal may deem fit and proper in facts and circumstance of the present case."9

4. Learned counsel appearing for the applicants contented that respondents have issued draft seniority list dated 10.09.2024 in complete disregard of OM dated 04.03.2014 and OM dated 13.08.2021. The applicants joined the service in month of December, 2017, after being directly recruited against UPSC special advertisement no. 53/2016 and respondents have erroneously applied rota quota with seniority quota and examination quota officers and has caused substantial loss to the applicants and they have been posted down in the draft seniority list dated 10.09.2024. The applicants being recruit of the year 2015-16, ought to be treated as enblock senior to the LDC promotes. The OM dated 04.03.2014 and 13.08.2021 clearly stipulates that for appointments made between 27.11.2012 to 18.11.2019, as seniority was not finalized by 18.11.2019, the relevant date for determining the recruitment year would be the date of sending requisition to the recruiting agency for direct recruits, which in the present case was 2015-16.
5. Learned counsel appearing for the applicants, after arguing at length, submits that applicants would be satisfied if direction is issued to the competent Authority among the respondents to consider and decide pending representations within a time bound manner.10

6. Learned counsels appearing for the respondents fairly submits that pending representation dated 09.10.2024 of applicants shall be considered, if not already considered, in accordance with law.
7. Heard with consent. We have considered the matter. In view of above submission and the fact of the matter that applicants are seeking direction to respondent no. 3 to decide the pending representation dated 09.10.2024 submitted by them by passing a reasoned and speaking order. We deem it just and proper that principles of natural justice would be met and hereby direct competent authority amongst the respondents to consider and decide pending representation dated 09.10.2024 (annexed at page 91 to 95) by taking a decision and by passing a reasoned and speaking order within a period of six weeks from the date of receipt of certified copy of order passed today.
8. Needless to say that this Tribunal has not expressed any opinion on the merits of the case and competent authority amongst the respondents is directed to consider and decide the pending representations, in accordance with law, without being influenced by the observations made in this order.11

9. In view of whereof, present O.A. stands disposed of at admission stage and in above indicated terms.
