Learned State counsel does not deny, on instructions, the contention of learned counsel for the petitioner that the recovery of the amount stated to have been looted from the complainant, has been made from nine other co-accused, with the allegation against the petitioner being that he was the person who had done the reconnaissance prior to the occurrence.
He is shown to have been in custody for more than 09 months, with no prosecution witnesses examined so far and with no other criminal case shown to be registered against him, as per the custody certificate filed in Court today.
That being so, the petition is allowed. The petitioner shall be admitted to bail upon his furnishing adequate bail bonds and surety bonds to the satisfaction of the learned trial Court.
