 Information sought

and background of the case:

The Appellant filed an RTI application dated 27.03.2021 seeking the following information with respect to 325 acres of land acquired for Vashishtha Off Shore project:-

1. Work order of No. EOA/MM/ES/onshore/VA851/105 ac 1101/2014 dated 09.05.2014 has been given to Technip KT India Ltd., to begin work on some part of the acquired land. When has Technip KT India Ltd., handed over the finished work. Request you to provide a copy of handover certificate provided by the Technip KT India Ltd.

And

2. Request you to provide the information of the Chief Guest who has to be inaugurated the completed project, when (date) the project was inaugurated, please provide information under Right to Information Act, 2005.

Having not received any response from the CPIO, the Appellant filed a First Appeal dated 15.05.2021. The FAA vide online order dated 04.08.2021 directed the CPIO, ONGC to provide relevant information to the Appellant within 20 days.

Aggrieved and dissatisfied, the Appellant approached the Commission with the instant Second Appeal.

Facts emerging in Course of Hearing:

An undated written submission has been received from CPIO stating that the RTI application was responded to by the CPIO vide letter dated 19.04.2021 through RTI MIS portal, stating as under:

1. M/s Technip KT India Ltd. had completed the construction of ONGC Vashishtha & SI Onshore Terminal Project Facilities at Odalarevu village In August 2018. As per Contract Agreement as such there is no provision for handover certificate to be provided by Technip KT India Ltd.

2. There was no chief guest invited for inaugurating the aforesaid completed project at Odalaveru.

Hearing was scheduled through virtual means after giving prior notice to both the parties. Both parties were heard through video conference and placed reliance on their respective contentions as discussed above.

Decision:

Perusal of the facts of the appeal at hand reveals that the queries raised by the Appellant had been duly addressed by the Respondent vide reply dated 19.04.2021, which has been enclosed with the written submission by the Respondent.

Considering the fact that the undated written submission filed by the Respondent has not been sent to the Appellant, the Respondent is hereby directed to send him a copy of the same with the relevant supporting documents through speed post, within two weeks of receipt of this order.

The aforementioned appeal is decided on the above terms.
