Preface
1. Petitioners being parents, wife and children of Rakesh
Kumar have approached Claims Tribunal, South West, Dwarka,
New Delhi seeking compensation for death of victim in motor
vehicle accident.
Background
2. As gleaned from application, Rakesh Kumar seated in the Cabin (front seat) of Truck No.HR-63B-3885 along with Vinod Kumar, on their way from Patan to Gobhana, suffered fatal injuries in a motor vehicle accident on 16.05.2013 at about 6:45 pm after respondent Chand Ram driving the Truck at very high speed in rash and negligent manner failed to control the vehicle which overturned near Dalpatpura, District Sikar, Rajasthan.

It is submitted that deceased Rakesh Kumar, aged 30 years, used to earn Rs.15,000/- per month as 'Driver' and respondents driver, owner & insurer are jointly & severally liable to compensate petitioners for the untimely death of Rakesh Kumar due to fatal injuries suffered in motor vehicle accident. 4. Respondents Chand Ram (driver) and Praveen Kumar (owner) have disputed - (i) rash and/or negligent driving of Truck No.HR-63B-3885 AND (ii) liability to pay compensation for death of Rakesh Kumar.
5. Respondent IFFCO TOKIO General Insurance Co. on its part has mentioned Cover Note/Policy No.81139094 of Truck No.HR-63B-3885 insured in the name of Praveen Kumar from 31.08.2012 to 30.08.2013 AND reserved its right to raise statutory defence under section 149(2) and all defences under section 170 of M.V. Act in case the driver and owner would fail to contest the case.
Inquiry
6. Following issues were settled on 27.10.2014 and matter was posted for petitioner's evidence.
i. Whether Shri Rakesh Kumar sustained fatal injuries in a motor vehicle accident dtd. 16/05/2013 due to rash and negligent driving of vehicle no. HR-63B-3885 by R-

7. Smt. Renu Devi examined as PW-1 has inter-alia deposed about (i) death of Rakesh Kumar, aged 30 years, in motor vehicle accident on 16.05.2013; (ii) Rakesh Kumar used to earn Rs.15,000/- per month as 'Driver' and contributed his entire income towards household expenses AND (iii) general and special damages suffered on account of untimely death of her MACT No.1381/2016 Renu Devi & Ors. Vs. Chand Ram & Ors. Page No. 3 of 18 husband in motor vehicle accident. She has relied upon following documents:
i. Certified copy of Criminal Record viz. - Final Report, Inquiry Report, Site-plan, Statement of Vinod Kumar, Notice under section 133 M.V. Act, Mechanical Inspection Report etc. in FIR No. 145/13,PS Patan, Sikar, Rajasthan- Ex.PW-1/1;
ii. Copy of DL of Rakesh - Ex.PW-1/2;
iii. Copy of Aadhaar Card of deponent - Ex.PW-1/3;
iv. Death Certificate of Rakesh Kumar - Ex.PW-1/4;
v. Copy of Aadhaar Card of Smt. Ompati - Ex.PW-1/5;
vi. Copy of Birth Certificate of children - Ex.PW-1/6

8. PW-2 Vinod Kumar has deposed that he was sitting besides Rakesh Kumar (brother) in the Cabin of Truck No.HR-63B-3885 which was being driven at very high speed in rash and negligent manner by Chand Ram (driver) and overturned near Dalpatpura, District Sikar, Rajasthan resulting in fatal injuries to Rakesh Kumar.
9. Cross-examination of PW-1 and PW-2 by Ld. counsel for respondents has been recorded and petitioner's evidence was closed on 19.10.2015.
10. Dr. Pawan Yadav examined as R3W1 has produced Postmortem Report of Rakesh Kumar S/o Ram Kumar who was 'Brought Dead' and identified his signature at point 'A' upon document/intimation to police by Civil Hospital, Narnaul, Haryana.

Ms. Ashna Khan, Senior Legal Executive, examined as R3W2 has denied liability of the insurer to pay compensation for death of Rakesh Kumar by adverting to IMT 28 for contending that 2nd driver travelling in the vehicle as 'Gratuitous Passenger' is not covered under the Policy. She has relied upon following documents for disputing liability to pay compensation for death of victim in road accident:
i. Authority Letter - Ex.R3W2/1; ii. Attested copy of Insurance Policy - Ex.R3W2/2; iii. Copy of notice under Order XII Rule 8 CPC - Ex.R3W2/3; iv. Postal Receipts - Ex.R3W2/4. v. Tracking Report - Ex.R3W2/5.
12. Cross-examination of R3W1 and R3W2 by Ld counsel for petitioners has been recorded and respondents' evidence was closed on 20.05.2024.
Discussion and Conclusion
13. Advocate Sh. Anupam Yashovardhan and Sh. R.K. Singh for petitioners AND Advocate Ms. Yukta Verma for IFFCO TOKIO General Insurance Co. have addressed their submissions.
14. I have carefully perused pleadings and evidence adduced on judicial file. My issue wise finding is recorded below:
15. Issue No.1:

16. PW-1 Smt. Renu Devi AND PW-2 Sh. Vinod Kumar have consistently deposed about death of Rakesh Kumar travelling in the Cabin of Truck No.HR-63B-3885 which was being driven at very high speed in rash and negligent manner by Chand Ram (driver) and overturned near Dalpatpura, District Sikar, Rajasthan resulting in fatal injuries to Rakesh Kumar.
17. PW-1 Smt. Renu Devi has fairly conceded of not being an eye-witness herself during cross-examination by Ld. counsel for insurance company.
18. PW-2 Vinod Kumar, on the other hand, has denied suggestions disputing his presence and/or rash and negligent driving of Truck by respondent Chand Ram. Following portion of cross-examination of PW-2 being relevant is extracted below for reference:
".....My deceased brother Rakesh was sitting in between me and driver of offending vehicle. The battery had fallen from the upper portion of the cabin of the offending vehicle which fell on the head of my brother and no one else sustained any injury due to fall of the battery. My statement which was recorded by Police is part of certified true copy of the criminal record is placed on record. Page no. 2 of Charge-sheet is my statement which is already exhibited as Ex.PW-1/1."

Respondents Chand Ram (driver) and Praveen Kumar (owner), on the other hand, have not entered the witness-box to rebut allegation of rash and negligent driving of Truck No.HR- 63B-3885 at very high speed which overturned near Dalpatpura, MACT No.1381/2016 Renu Devi & Ors. Vs. Chand Ram & Ors. Page No. 6 of 18 District Sikar, Rajasthan. Adverse inference is therefore required to be raised against the driver as per the dicta of Hon'ble High Court of Orissa in National Insurance Company Ltd. Vs. Durdadshya Kumar Samal & Ors. 1987 SCC Online Ori. 57 AND Cholamandalam MS General Insurance Co. Vs. Smt. Kamlesh & Ors. decided by Hon'ble High Court of Delhi on 11 th November, 2008.
20. It is all the more well settled law that negligence of the driver in case of road traffic accident is required to be established on the touchstone of preponderance of probability and standard of proof beyond reasonable doubt does not apply to claim petitions under Motor Vehicle Act as held by Hon'ble Supreme Court of India in para 15 of Bimla Devi & Ors. Vs. Himachal Road Transport Corporation & Ors (2009) 13 SCC 530.
21. Following observations in para 15 of aforesaid judgment of Hon'ble Apex Court being relevant are extracted herein below:
"15. In a situation of this nature, the Tribunal has rightly taken a holistic view of the matter. It was necessary to be borne in mind that strict proof of an accident caused by a particular bus in a particular manner may not be possible to be done by the claimants. The claimants were merely to establish their case on the touchstone of preponderance of probability. The standard of proof beyond reasonable doubt could not have been applied...."
22. Similar observation has been recorded by Hon'ble High Court of Delhi in para 12 of its judgment delivered in National Insurance Co. Ltd. Vs. Smt. Pushpa Rana & Ors. 2007 SCC Online Del 1700 by holding that proceedings under Motor MACT No.1381/2016 Renu Devi & Ors. Vs. Chand Ram & Ors. Page No. 7 of 18 Vehicle Act are not akin to proceeding in a civil suit hence strict rules of evidence are not required to be followed and FIR against the driver along with criminal record of the case showing completion of investigation by the police leading to Final Report are sufficient proof to reach the conclusion that the driver was negligent.
23. FINDING: Issue No.1 is therefore decided by holding that Rakesh Kumar has died consequent to fatal injuries suffered in motor vehicle accident on 16.05.2013 as a result of rash and negligent driving of Truck No.HR-63B-3885 by respondent Chand Ram (driver) which vehicle was registered in the name of Praveen Kumar (owner) and insured with IFFCO TOKIO General Insurance Co.
24. Issue No.2 Whether the petitioners are entitled to claim compensation, if so, what amount and from whom ? ... OPP
25. Rakesh Kumar having expired on 16.05.2013 is survived by Smt. Renu Devi (wife), Depanshu (son), Shiksha (daughter), Pooja (daughter) AND Smt. Ompati (mother).
26. Application under section 151 CPC filed along with copy of statement recorded before Gaon Panchayat Gohana & Salawas for contending re-marriage of Smt. Renu Devi has been opposed by petitioner no.1 and no evidence has been adduced to establish re-marriage of Smt. Renu Devi.
27. Quantum of compensation is required to be assessed under following heads:

28. PW1 Smt. Renu Devi having deposed about monthly income Rs.15,000/- of Rakesh Kumar by working as driver has fairly conceded to have not filed any document verifying monthly income of her husband.
29. Since copy of DL No. 0919940076367 of Rakesh Kumar has been referred as Ex.PW-1/2 so monthly income of Rakesh Kumar in the absence of cogent evidence is taken as per minimum wage of 'Skilled Worker' @ Rs.9,386/- applicable in Delhi w.e.f. 01.04.2013.
Age & Multiplier
30. Date of Birth of Rakesh Kumar is recorded as 10.02.1970 in copy of Driving Licence - Ex.PW-1/2. He had, therefore, completed 43 years of age at the time of death and Multiplier of 14 will apply in the case as held in para 19 read with para 42 of Sarla Verma & Ors vs. DTC (2009) 6 SCC 121 which has been approved by the Constitution Bench of Hon'ble Supreme Court of India in para 42 of National Insurance Co. Ltd. Vs. Pranay Sethi (2017) 16 SCC 680.
Future Prospects
31. Rakesh Kumar was below 50 years of age at the time of death and petitioners are entitled to future prospect @ 25% upon notional income Rs.9,386/- as laid down by the Constitution Bench of Hon'ble Supreme Court of India in para 59.4 of National Insurance Co. Ltd. Vs. Pranay Sethi (Supra). Personal Living and Expenses
32. Deceased Rakesh Kumar is survived by Smt. Renu Devi (wife), Depanshu (son), Shiksha (daughter), Pooja (daughter) AND Smt. Ompati (mother) and one fourth of notional income MACT No.1381/2016 Renu Devi & Ors. Vs. Chand Ram & Ors. Page No. 9 of 18 Rs.9,386/- is required to be deducted towards personal living and expenses as per principles laid down in paras 31 and 32 of Sarla Verma & Ors. Vs. DTC (2009) 6 SCC 121 which have been affirmed by Hon'ble Supreme Court of India in para 41 of National Insurance Co. Ltd. Vs. Pranay Sethi (Supra). Loss of Dependency
33. Loss of dependency is calculated as Rs.9,386/- x 125/100 x 14 x 12 x 3/4 = Rs.14,78,295/- (Rupees Fourteen Lakhs Seventy Eight Thousand Two Hundred & Ninety Five only). Conventional Heads
34. Hon'ble Supreme Court of India in para 59.8 of National Insurance Co. Ltd. Vs. Pranay Sethi (Supra) decided on 31.10.2017 has laid down reasonable figures under the heads -
(i) loss of estate; (ii) loss of consortium AND (iii) funeral expenses fixed as Rs.15,000/-; Rs.40,000/- and Rs.15,000/- respectively to be enhanced @ 10% after every three years. Loss of Estate
35. Accordingly, Rs.18,150/- (Rupees Eighteen Thousand One Hundred Fifty only) is awarded to petitioners under the head - 'loss of estate' in terms of aforesaid judgment of Hon'ble Supreme Court of India.
Funeral Expenses
36. Similarly, another sum of Rs.18,150/- (Rupees Eighteen Thousand One Hundred Fifty only) is awarded to petitioners under the head - 'funeral expenses' in terms of the law/guidelines laid down in aforesaid case.

37. In view of the law/guidelines laid down in (i) Pranay Sethi (Supra) read with (ii) Magma General Insurance Co. Ltd vs. Nanu Ram (2018) 18 SCC 130 AND (iii) United India Insurance Co. Ltd. vs Satinder Kaur (2021) 11 SCC 780, a sum of Rs.48,400 x 05 = Rs.2,42,000/- (Rupees Two Lakhs Forty Two Thousand only) is awarded to petitioners as compensation under the head 'loss of consortium'.

INTEREST
39. There is nothing on record to justify withholding interest on the award amount. Having regard to the facts and circumstances of the present case, it will be just and proper to grant interest @ 7.5% per annum on the award amount in terms of judgment of Hon'ble Supreme Court of India in National Insurance Co. Ltd. Vs. Mannat Johar & Anr. (2019) 15 SCC
260. Petitioners are therefore awarded interest @ 7.5% per annum upon compensation Rs.17,57,000/- (Rupees Seventeen Lakhs & Fifty Seven Thousand only) from the date of filing of petition on 29.01.2014 till notice of deposit under Order XXI Rule 1 CPC to petitioner/counsel.

40. Advocate Ms. Yukta Verma has adverted to testimony of R3W2 Ms. Ashna Khan read with attested copy of Policy for contending that 2nd driver travelling in the vehicle as 'Gratuitous Passenger' is not covered under the Policy as per section 147(1)
(b)(i) of M.V. Act, 1988.
41. It is apposite to record that R3W2 Ms. Ashna Khan having insisted that driver & owner of vehicle are not covered under 3rd Party has nonetheless admitted to have not filed IMT 28 along with her affidavit.
42. Attested copy of Insurance Policy Ex.R3W2/2 would reveal - (i) Basic TP Premium Rs.12,478/-; (ii) Personal Accident Premium Rs.100/- AND (iii) Legal Liability to Driver (IMT 28) Premium Rs.50/-. Further, Truck No.HR-63B-3885 was insured with IFFCO TOKIO General Insurance Co. under 'Commercial Vehicle Certificate of Insurance-cum-Schedule' AND IMT 28 deals with Legal Liability to paid driver and/or conductor and/or cleaner employed in connection with the operation of insured vehicle.
43. Since Rakesh Kumar, employed as driver of the Truck, has died due to fatal injuries suffered in motor vehicle accident after respondent Chand Ram failed to control the vehicle which overturned near Dalpatpura, District Sikar, Rajasthan so IFFCO TOKIO General Insurance Co. having collected Premium for 'Personal Accident' (owner-driver) AND 'Legal Liability to Driver (IMT 28)' cannot be absolved of its liability to compensate for death of Rakesh Kumar.

44. FINDING : Issue No.2 is decided accordingly by holding that R3/IFFCO TOKIO General Insurance Co. shall pay award amount with interest to petitioners in the absence of any statutory defence under section 149(2) of M.V. Act. RELIEF
45. In view of foregoing discussion and observations and having regard to the facts and circumstances of the case, award for a sum of Rs.17,57,000/- (Rupees Seventeen Lakhs & Fifty Seven Thousand only) with interest @ 7.5% p.a. from the date of filing of petition on 29.01.2014 till notice of deposit under Order XXI Rule 1 CPC is passed in favour of petitioners.
46. Award amount with interest shall be paid by respondent IFFCO TOKIO General Insurance Co.

47. Award amount Rs.17,57,000/- shall be apportioned amongst petitioners in following manner:

52. Branch Manager, SBI, District Courts Complex, Dwarka, Sector-10, New Delhi is directed to transfer Rs.6,57,000/- with proportionate interest in MACT SB Account of Smt. Renu Devi AND Rs.2,00,000/- with proportionate interest in MACT SB Account of Smt. Ompati.
53. Balance Rs.3,00,000/- each with proportionate interest be kept in FDR/Annuity Account to be released in MACT S.B. MACT No.1381/2016 Renu Devi & Ors. Vs. Chand Ram & Ors. Page No. 17 of 18 Accounts of Dipanshu, Shiksha & Pooja upon their attaining the age of majority.
54. Respondent IFFCO TOKIO General Insurance Co. shall inform petitioners/counsel regarding award amount being deposited in MACT Account through registered post.
55. Copy of Award be sent to Manager, SBI, District Courts Complex, Sector-10, Dwarka, New Delhi AND Manager of concerned banks for information/ compliance.
56. Dasti copy of Award be given to Ld. Counsel for petitioners and insurance company.
57. Ahlmad is directed to prepare separate miscellaneous file to be listed on 14.11.2025 for filing compliance report.
58. File be consigned to the record room.
