% 03.08.2022 On 23.05.2022, this Court had directed the learned senior counsel for the petitioner to move an application for pre-poning the date of 13.07.2022 and further the Metropolitan Magistrate to consider the application under 173(8) Cr.P.C. filed by the petitioner.
However, today it is submitted by Mr. Manan, learned senior counsel that on account of his personal difficulty he could not file his application either for pre-ponement or argue the application on 13.07.2022.
The next date before the Metropolitan Magistrate for disposal of the application 173(8) Cr.P.C. is now listed on 17.09.2022.

The Metropolitan Magistrate shall take up the application under 173(8) Cr.P.C. and decide the same expeditiously.
The decision of Metropolitan Magistrate be placed on record before the next date of hearing.
