The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of SRI.V.RAMCHANDER GOUD, Advocate for the petitioners. 18 ORDER:
These petitions are filed under Section 151 of Code of Civil Procedure, seeking interim direction against respondent -- medical college to permit the petitioners to report and pay fee for the admission into P.G.Medical Course (General Medicine) for the academic year 2020-21 under Competent Authority Quota (Phase-l) on or before the deadline i.e. 10.06.2020, which is set by respondent No.4 pending disposal of the writ petitions.
The writ petitions are filed questioning the act of the respondent -- college authorities denying admission on payment of fee fixed by regulatory authority though they were selected as a candidate for admission into P.G. Medical Course on the ground that they are going to run the institutions. Therefore, the act of the medical colleges is questioned impleading the concerned authorities of the State.
During pendency of writ petitions, in pursuance of the Public Notice No.MCI-7(10)/10/2020-Legal/10310/102394 issued by Board of Governors in supersession of Medical Council of India, time was extended for admissions into P.G.Medical Course. Thereupon, the matter was adjourned from time to time either at the request of the petitioners or respondents, but till date, no counters are filed before the Court.
While the matter stood thus, Dharnas have taken place by P.G. Medical students against the denial of admission and due to Dharnas conducted by P.G. Medical Students, Andhra Pradesh Private Medical and Dental Colleges Managements Association and students entered into an understanding subject to certain conditions mentioned in the affidavit and result of the writ petitions, issued a public notice dated 29.06.2020 by the Secretary, Andhra Pradesh Private Medical and Dental Colleges Managements Association, wherein it is stated as follows:
"Covid-19 pandemic has taken the country by storm. As a result most of the educational institutions remained closed since the last week of March 2020. Affiliated hospitals of Private unaided medical colleges were converted into Covid-19 Hospitals.
In the wake of resurgence of Covid-19 infection in the fortnight, examinations were cancelled or postponed to later date; admission process to professional institutions was delayed. Students community was put to undue distress. In the midst of the pandemonium, APHER & MC has surprised the private medical and dental colleges managements association by fixing lower & unsustainable fee structure to the postgraduate medical and dental course in the state of Andhra Pradesh.
Aggrieved by decision of the Commission and its approval by AP Government through its GOMs.No.56 of H & FW (C1) dated 29 May 2020, the APPMDCMA has filed a batch of WPs No.9969 of 2020, 9973 of 2020 and 9880 of 2020 in AP High Court in the first week of Jun 2020. The WP is yet to be adjudicated.
The member institutions of the association are deeply concerned with the deleterious effects on postponement of the admission process on healthcare manpower generation in the State.
In the light of the above APPMDCMA has unanimously decided to admit candidates selected to various PG Courses by Dr.NTR University of Health Sciences subject to condition that each student shall give an affidavit stating that he/she will abide by the decision of Court of Law in all matters including tuition and other fee in the aforesaid batch of writ petitions."
In pursuance of the same, two proforma affidavits were prepared for admission into P.G. Medical Course by Association subject to furnishing affidavit by the students. First affidavit is styled as "Tuition fee bond by student for convenor quota, Management quota" and second affidavit is styled as "Tuition fee affidavit by student for convenor quota, Management quota."
Students and managements agreed for the terms mentioned in the said affidavits, more particularly, to pay tuition fee of Rs.45,000/- for three (3) years in addition to the fee fixed by the authorities and the same is subject to final result of the writ petitions. Later, a notification dated 04.07.2020 was issued by Dr.NTR University of Health Sciences, Andhra Pradesh, Vijayawada informing that the last date for reporting at the allotted colleges by the selected candidates into PG Medical/Dental Courses for the academic year 2020-21 under Competent Authority Quota (Phase-1) is extended up to 04.00 p.m. on 10.07.2020.
Therefore, it is evident from the material on record, College managements and the students, who were selected for admission into P.G. Medical Course came to an understanding with regard to payment of fee, subject to result of the writ petitions and the students agreed for payment of additional amount of Rs.45,000/- for each year, the Managements also agreed to admit students on compliance of conditions, subject to result of the writ petitions.
Senior Counsel Sri K.G.Krishna Murthy, Y.V.Ravi Prasad for the petitioners, and learned counsel Sri K.Rammanna Dora, Dharmesh DK Jaiswal, for the petitioners agreed to comply the conditions of understanding, whereas Sri A.Satya Prasad, learned senior counsel for the Medical College, Sri Vijay Kumar, 20 learned Counsel for the Dr.NTR University of Health Sciences, Andhra Pradesh, Vijayawada also agreed to admit the students subject to compliance of terms and conditions mentioned in the affidavits referred above.
Whereas Sri D.V.Seetharama Murthy, learned Senior Counsel for Medical College, requested to issue a direction to pay 50% of the fee fixed for the last year in addition to the fee fixed by the regulatory authority for the year. But at this stage, it is difficult to accept the request of Sri D.V.Seetharama Murthy, learned Senior Counsel, appearing for Medical College, since the said college is a member of Andhra Pradesh Private Medical and Dental Colleges Managements Association, when the association itself agreed for admission subject to furnishing bond for payment of tuition fee etc., prescribed in the two affidavits referred above.
Learned Standing Counsel for Dr.NTR University of Health Sciences Sri Vijay Kumar and learned Government Pleader for Medical Education readily agreed for admission of students into P.G.Medical Course as they were already selected for admission into P.G.Medical Course subject to compliance of requirements. As the time was extended for admission into P.G.Medical Course (Phase-l) by notification issued by Dr.NTR University of Health Sciences, students must report to the concerned college for admission into P.G. Medical Course (Phase-l), otherwise they will lose their academic year in prosecuting their studies. On the other hand, College will not sustain any loss, in case the students are admitted into P.G. medical course subject to the understanding they arrived at. Therefore, considering the facts and circumstances of the case including subsequent events that took place after filing writ petitions, we direct the medical colleges in all the petitions to permit the petitioners/students to pay fee fixed by the Regulatory authority by executing bond in the proforma prescribed by the Andhra Pradesh Private Medical and Dental Colleges Managements Association within the specified time as notified by Dr.NTR University of Health Sciences, Andhra Pradesh, Vijayawada. This direction is only to subject to result of the writ petitions.
