Facts :-
Heard today dated 04.01.2013. Appellant not present. The Public Authority is represented by Shri SMMS Maricar, Joint GM.
2. In the appeal memo dated 31.8.2012 filed before this Commission, the appellant has sought inspection of original documents in possession of HAPP Management. He has, however, not specified the documents which he proposes to inspect. However, Shri Maricar submits that the documents in-question relate to fraudulent mode of payment by the contractor to the contract labour. He clarifies that copies of these documents are available with HAPP but the originals are with the contractor who is no more working with HAPP and a new contractor has come in his place. He also submits that there is a possibility of these documents being available with the Labour Welfare Commissioner which is a part of HAPP establishment.
3. In the facts and circumstances of the case, it is ordered that the appellant may be invited for inspection of requisite documents by the CPIO in next 04 weeks time. As the appellant has insisted on inspection of original documents, the CPIO is hereby directed to procure original documents from the quarters concerned, if available, and facilitate the inspection thereof. The appellant will be entitled to obtain copies of documents if he so desires, free of cost, upto a maximum of 200 pages. If he needs additional pages, he will pay as per rules.
