Section 136(3) in The Maharashtra Co-Operative Societies Act, 1960
(3)Where any property is sold in the exercise or purported exercise of a power of sale under section 133, the title of the purchaser shall not be questioned on the ground that the circumstances required for authorising the sale had not arisen or due notice of the sale was not given, or the power of sale was otherwise improperly or irregularly exercised:Provided that, any person who suffers damage on account of unauthorised, improper or irregular exercise of such power shall have a remedy in damages against the [Co-operative Agriculture and Rural Multipurpose Development Bank] [These words were substituted for the words 'State Agriculture and Rural Development Bank' and 'an Agriculture and Rural Development Bank' by Maharashtra 41 of 2005, (w.e.f. 25-8-2005), Section 8.].
