ORDER:
This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') by the petitioners-Accused Nos.1 to 2 to quash the proceedings against them in Crime No.620 of 2022 on the file of Station House Officer, Shamshabad Police Station, Cyberabad, registered for the offences alleged under Sections 406, 420, 188 of IPC and Section 20(2) of COTPA Act, 2003.
2. Learned counsel for the petitioners submits that this case is squarely covered with the Common Order rendered by this Hon'ble Court in Criminal Petition Nos.6235 of 2022 and batch, dated 26.09.2022.
3. The petitioners - Accused Nos.1 to 2 are being prosecuted for the offences under Sections 406, 420, 188 of IPC and Section 20(2) of COTPA Act, 2003. This Court had repeatedly quashed the proceedings wherein tobacco products were found on the ground that the provisions under Sections 406, 420, 188 of IPC and Section 20(2) of COTPA Act, 2003, are not attracted. This Court vide Crl.Petition Nos.6235 of 2022 and batch dated KS,J Crl.Petition No.11909 of 2022 2 26.09.2022 had quashed the proceedings against the Accused persons.
4. Resultantly, the Criminal Petitions is allowed. The proceedings against the petitioners in Crime No.620 of 2022 on the file of Station House Officer, Shamshabad Police Station, Cyberabad, are hereby quashed making common order copy of Crl.Petition No.6235 of 2022 and batch, dated 26.09.2022 as a part of this order.
Miscellaneous applications pending, if any, shall stand closed.
