Information sought:
1. The Appellant filed an RTI application dated 11.04.2024 seeking the following information:
"i)Is a family pensioner (Wife) is eligible to obtain / get a Service Book in Original / True Copy certified by the department, of the Pensioner (Husband) from CPWD in correspondence address."
2. CPIO furnished a reply to the appellant on dated 10.05.2024 stating as under:
"The pages of service book (of your husband Late T.K.Banerjee, Ex. AE) counted to be 78 (Seventy Eight) pages only containing in Part-
I, Part-II and Part-III of Service book. In view of above and also as per RTI Gazette Notification dated 16.09.2005, you have to deposit Rs. 156.00 (Rupees One Hundred Fifty Six) only [i.e. Rs. 2.00 (Rupees Two) only for each page of service book] through Payment Gateway of Bharatkosh (Refer DDO code 143820 and PAO Code 043810) to this Office immediately for providing of copy of service book".
3. The appellant filed First Appeal dated 12.05.2024.
4. FAA vide its order dated 20.05.2024 stated as under:
"With reference to your RTI Appeal as mentioned above, it is to state that the RTI Query has been disposed off by the concerned CPIO O/o the EE-Silchar, CPWD, Silchar, vide his letter no 35(DB)/SCD/EE-Silchar/2124-25/116 cdh. 16.05.2024, copy addressed to you and endorsed to this Hence, both the RTI Query No. CPWDG/R/E/24/10003 dt. 11.04.2024 as well as the RTI Appeal No. CPWDG/A/E/24/00002 dt. 12.05.2024 stands disposed off."
Letter dated 16.05.2024 addressed to appellant states as under: -
"With reference to your RTI application dated 11.04.2024 and subsequent payment of additional fees of Rs 166 on dated 15.05.2024, please find enclosed herewith the copy of service took of your husband Late TK Banerjee, Ex. AE counted to be 78 (Seventy Eight) pages only containing in Pan Part-ll and Part-Ill of Service book for your record please.Page 2 of 5
Encl:- Copy of service book Pt. I, II and III."
5. Feeling aggrieved and dissatisfied, Appellant approached the Commission with the instant Second Appeal.
Relevant Facts emerged during Hearing:
The following were present: -

6. Proof of having served a copy of Second Appeals on Respondent, while filing the same in CIC, is not available on record.

The Appellant inter alia submitted that she had filed an RTI application seeking certified copies of service book of her husband, however the certified copies of service book was not provided despite the specific prayer for the same. It is also submitted that fees of Rs. 156/- as mentioned in the CPIO reply dated 10.05.2024 had already been paid for the certified copies. However, on non-receipt of any reply she filed a First Appeal on 12.05.2024 which was disposed of by a non-speaking order on 20.05.2024. In the meantime, CPIO replied on 16.05.2024 by providing photocopies of the sought information.

Written submissions dated 09.02.2026 filed by the appellant is taken on record which states that she had filed an RTI application bearing Registration No. CPWDG/R/E/24/00003 before the CPIO, Central Public Works Department (CPWD), seeking certified/true copy or original Service Book of her husband Late Shri Tarnal Krishna Banerjee, who worked as Assistant Engineer (Civil) at Silchar Central Division, CPWD till 28.02.1998. She stated that despite specifically requesting a certified/true copy of the Service Book, the department vide RTI reply No. 35(DB)/SCD/EE- Silchar/2024-25/27(H) and letter No. 35(DB)/SCD/EE-Silchar/2024- 25/116 supplied only a photocopy of the Service Book. It is further submitted that the copy supplied, does not bear any official seal or authorized signature of the competent authority, although the prescribed fee for certified/true copy was paid as demanded by the CPIO. The Appellant has therefore requested that a duly certified/true copy of the Service Book of her husband Late Shri T.K. Banerjee be provided to her.
9. The respondent while defending their case inter alia submitted that true copy was provided by the then CPIO, Mr. Pradeep Kr. Verma, E.E-Silchar, Page 3 of 5 CPWD. However, they are ready to give certified copies of the information sought.
Decision:
10.The Commission after adverting to the facts and circumstances of the case, hearing both the parties and perusal of the records and written submissions notes that the copies of documents as provided by the respondent CPIO is merely a photocopy of sought documents. It is also noted that Appellant had already paid the fees for certified copies. However, the then CPIO Mr. Pradeep Kr. Verma, E.E-Silchar, CPWD provided only photocopies of the documents, which is not proper in terms of DoPT Circular 10/1/2013-IR dated 06.10.2015.
Based on the facts of the matter placed on record, the Commission directs the respondent CPIO to provide the certified copies of the sought information to the appellant, free of cost, within 15 days from the receipt of this order, under intimation to the Commission.
With the above observations and directions, the appeal is disposed of.
