The status report has been filed by the learned Additional Public Prosecutor.
2. Heard the learned counsel for all parties and the parties present before this Court.

3. Firstly, it is seen that a total of 233 plots have been sold for a value of Rs.31,06,90,452/-. It is heartening to note that a majority of the plots have been bid for by the victims. Two plots have been purchased by persons who are not victims. In the list annexed to the status report, their names are found at Sl.Nos.37 and 164. It is further seen that Sl.No.37 relates to Sangeeth Garden, Madurai, Plot - Institute Land 2 and that as against the minimum upset price of Rs.20,90,400/-, the bid amount is Rs.34,20,400/-.
4. The learned counsel appearing on behalf of the company/accused, the learned Additional Public Prosecutor appearing for the competent authority/investigating authority and the learned counsel appearing for the victims have no objection to confirming the same.
5. Similarly, in respect of the other plot which is mentioned in Sl. No. 164, it relates to Plot No. 4, Tanjore and it has been bid for at the upset price of Rs.24,00,000/- and all three sides have no objection. _____________ Page No. 26 of 34 https://www.mhc.tn.gov.in/judis Crl.O.P.(MD) No.15498 of 2024 etc. batch
6. The Court has also considered the value of the plot and the value of the bids. The said bids stand confirmed. The competent authority may intimate the successful bidders to deposit the amount. The competent authority shall intimate in writing, granting them at least 20 working days and requesting the bidders to deposit the amount on or before the said date. If the bidders deposit the amount, a sale certificate, as if the sale has been held as per the provisions of the Tamil Nadu Protection of Interests of Depositors (In Financial Establishments) Act, 1997 [TNPID Act] and the Banning of Unregulated Deposit Schemes Act, 2019 [BUDS Act], shall be issued by the learned Special Judge, Special Court under the TNPID Act, Madurai, upon a memo being filed by the investigating authority/competent authority. It is made clear that periodically, such memos shall be filed before the learned Special Judge and sale certificates in respect of the confirmed auctions shall be issued, which may be duly presented before the Sub-Registrar by following the appropriate procedure.
7. With reference to the victims participating in the auction already, this Court has made it clear that they need not deposit the EMD amount. In this regard, today, a representation is also made on behalf of the victims _____________ Page No. 27 of 34 https://www.mhc.tn.gov.in/judis Crl.O.P.(MD) No.15498 of 2024 etc. batch who filed complaints after the cut-off date. Since it is stated that some of the complainants have filed after the cut-off date, subject to other considerations, the list shall be circulated to the learned counsel appearing on behalf of the company/accused. If they also agree prima facie with their deposits, they can also be included in the list of complainants, with an entry that the complaints were filed after the cut-off date and they can also participate without depositing the EMD amount. Once the complainant number is given, the said process shall be expedited, as the online schedule for auction is ongoing, as early as possible. Within two to three working days, the same shall be verified and listed. Once the same is listed, they can also participate without the EMD amount.

As far as the aforesaid feature is concerned, this Court has already made it clear that under any circumstances, the victims will not forfeit any amount from their deposit merely because they have participated. As far as the deposit is concerned, it is already made clear that they will be required to deposit only to the extent in excess of the amount already deposited by them. If ultimately this Court comes to the conclusion that all the victims are being paid 100%, they will not be required to deposit any additional amount. If the total amount distributed _____________ Page No. 28 of 34 https://www.mhc.tn.gov.in/judis Crl.O.P.(MD) No.15498 of 2024 etc. batch is less than 100%, even then, it will be the choice of the victims. If they do not wish to deposit any excess amount and instead get their amount back and withdraw, even at that point of time, they will not forfeit any part of their EMD. These concessions are being extended only with the view that since these victims have deposited their amounts and are participating in the bidding for the plots and if the plots are ultimately purchased by them to that extent, it would amount to redressal of their grievances. With the above in mind, the above clarifications are issued. A fresh press release shall also be issued, duly communicating the clarifications given by this Court.

With reference to an apprehension which was also expressed by some of the learned counsel appearing on behalf of the victims that with reference to some of the plots, even though they have registered, when they try to submit their bids, they face certain online glitches, in this regard, the learned counsel appearing on behalf of MSTC has given the following helpline numbers:

The same is recorded. In the press release to be issued by the competent authority, adequate publicity shall also be given to these numbers.
10. With reference to 27 victims who have bid more than their deposit amount, let the learned counsel appearing on behalf of the company/accused verify the same and if they have no objection, their bids can be accepted. They can be directed to deposit the balance amount, after deducting their deposit amount, within the time as may be indicated by this Court on the next occasion. It is made clear that the learned counsel for the company/accused can give their no objection on the next occasion, as far as their bids are concerned. On behalf of the competent authority, there is no objection with reference to the quantum of the amount. The same is recorded.
11. It is submitted that at one place, near Guru Theatre, Kalavasal Bypass Road area, the victims are arranging for registration and bidding _____________ Page No. 30 of 34 https://www.mhc.tn.gov.in/judis Crl.O.P.(MD) No.15498 of 2024 etc. batch events. Let them do so without disturbing the general public and the election-related works and rallies. A copy of this order shall be brought to the notice of the personnel on election duty so that they do not totally prohibit the same, as this is an ongoing activity pursuant to the scheduled online auction of plots and if necessary, the local police shall also be informed by the investigating authority to post one or two police personnel to inform the other election duty personnel that a permitted activity by this Court is going on. The victims shall also ensure that they do not disturb others.
12. It is also recorded that the plots which are scheduled to be auctioned on 23.04.2026 are rescheduled to 15.05.2026 on account of the general elections. The press release shall also contain the same. The facts shall be informed to the Returning officer, Madurai.
