01. 1. Heard learned counsel for the petitioner and learned counsel for the State.

2. The petitioner is an accused in connection with 2(a) CC Case No.127 of 2022, pending in the Court of learned N.G.N.-cum- J.M.F.C., Attabira, arising out of Excise Station, Attabira P.R. No.155 of 2022-23 dated 15.10.2022, for alleged commission of offences under Section 52(a)(i) of Orissa Excise Act.

3. Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Bargarh, by order dated 01.11.2022 in the aforementioned case, the present BLAPL has been filed.

4. Taking into account the nature of allegations and the period of custody since 15.10.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin.

5. A memo has been filed by the learned counsel for the petitioner stating therein that the petitioner has no criminal proclivity. The same is taken on record.

6. Before releasing the petitioner, learned Court in seisin shall verify assertion regarding the criminal antecedents of similar nature. If it comes to the fore that the petitioner has such criminal antecedent, this order shall stand recalled.

7. Accordingly, the BLAPL stands disposed of.

8. Urgent certified copy of this order be granted as per rule.
