Applicant's counsel submits that none of the candidates has qualified in the examination in question. He further submitted that the applicant wants to give a fresh representation to the General Manager, E.Co. Railway, Bhubaneswar (Respondent No.3) within a period of two weeks from the passing of this order.
In view of such submissions as made above, this O.A. is disposed of by granting liberty to the applicant to file fresh representation before Respondent No.3/competent authority within a period of two weeks from passing of this order. Thereafter, if such representation is filed, the Respondent No.3/competent authority shall consider and dispose of the same in accordance with the rules governing the fields by passing a reasoned and speaking order under intimation to the applicant within a period of six weeks thereafter. The O.A. is disposed of accordingly without going into the merit of this case.
It is expected that Respondent No.3 will not be influenced by the order dated 25.02.2019 (Annexure-A/5) passed rejecting the applicant's earlier representation and will reconsider the same in accordance with relevant rules and law. This order is passed without prejudice to the rights of the parties.
Applicant will have liberty to send copy of this order along with copy of the paper books and the representation to Respondent No.3.
Copy of this order to Ld. Counsels for both the sides.
