ORAL ORDER
4 28-03-2019Writ petition has been listed under the heading "To be mentioned" since with agreement of the parties when the matter was taken up on 26.3.2019 this Court had decided to direct the authorities to consider petitioner's claim in light of order passed in LPA No. 1283 of 2017. However, when the matter was placed for being signed in the Chambers, it appeared from the order passed in LPA No. 1238 of 2017 that order of the Division Bench stipulates that the same shall be limited to the appellants therein.
The issue boils down to Annexure R3-5/H of the supplementary counter affidavit filed by respondents no. 3 to 5. Specific stand with respect to the said annexure is that it is for the Commissioner to take a decision whether age relaxation will be granted to the petitioners, and if so, to what extent.
Since the issue is to be decided by respondent authorities, it is needless to say that if the respondents themselves take a decision as regards any relaxation to be given to all the candidates, the petitioners may be in a position to claim the same.
As the issue is yet to be decided, no further order is Patna High Court CWJC No.6171 of 2015(4) dt.28-03-2019 5/5 required to be passed at this juncture, as it is agreed by the parties that if any decision is taken to grant relaxation to the petitioners, the petitioners may also be entitled to the same.
Writ petition stands disposed of.
