Present petition is filed under Section 528 of the B.N.S.S. seeking directions for fair investigation and transfer the investigation qua the FIR No.557/2023 dated 21.12.2023 registered at Police Station Bandikui, District Dausa for the offence under Section 306 of IPC to CBI.

Learned counsel for the petitioner has submitted that despite the fact that the allegations leveled have been of heinous nature and is substantiated by material evidences, no effective investigation has been carried out. It is further submitted that the petitioner has also filed a representation dated 16.01.2024 (Annexure-3) before the appropriate authority. Howsoever, a deaf ear has been tendered qua the same. The said action of the police authorities is against the provisions of the Rajasthan Police Rules, more particularly Section 29 and violates the fundamental rights (Downloaded on 18/09/2024 at 08:58:25 PM) [2024:RJ-JP:38687] (2 of 2) [CRLMP-4695/2024] of the petitioner as enshrined under Article 21 and 39A of the Constitution of India.

Learned Public Prosecutor is unable to refute the said contentions.

Learned counsel for the petitioner is directed to file a representation before Superintendent of Police, Dausa within a period of three working days from today.

Superintendent of Police, Dausa is directed to give audience to the petitioner on 23.09.2024 and pass a speaking order strictly in accordance with the law.

Accordingly, present petition is disposed of. Pending applications, if any, stand disposed of.
